Councilmember Van Wagner stated that Mr. Schnelle informed her that it would <br />be a good idea to review the City's liability insurance because of the increase <br />in activity at various park sites. Council agreed. <br /> <br />Case #13: Dickenson Industrial Buildin~ Expansion: <br /> <br />Mr. Howard Becker of Becker and Sons, Bethel, Minnesota - Stated that <br />Dickenson's have decided to go with a Type I construction and that they now <br />need a couple of easements and a zero lot line variance. <br /> <br />Councilmembers are not in objection to the zero lot line variance. <br /> <br />Mr. Becker then presented Council with a letter from Prestress Concrete to <br />Dickenson Lines stating their support of the expansion and also a Hold Harmless <br />Agreement between Prestress and Dickenson Lines. <br /> <br />Mr. Berg stated that Code requires a 20' open space area between business as <br />a fire exit or corridor and complying with code will require a perpetual easement, <br />and for the City's protection that easement should be a qu~e~, claim deed <br />easement, d~c~ ~ ~"~ <br /> <br />Mr. Becker noted that Prestress is also in the process of expanding and inquired <br />if giving an easement to Dickenson Lines would affect Prestress' collateral <br />power. <br /> <br />City Attorney Goodrich replied that it would not affect Prestress~ collateral <br />and that it appears by Prestress' letter that they are supportive of whatever <br />it takes to make it possible for Dickenson Lines to expand. <br /> <br />Mr. Berg noted that the easement would apply to drainage also. <br /> <br />Mayor Gamec suggested granting approval prior to conducting a Board of Adjustment <br />public hearing because Dickenson's are working on a tight schedule and Prestress <br />has no apparent objections. <br /> <br />Mr. Goodrich stated that saying a public hearing is not necessary would be <br />a ordinance violation. <br /> <br />Councilmember Van Wagner noted that the only person or entity affected by the <br />public hearing would be Prestress. <br /> <br />Mayor Gamec stated that the City has a letter from Prestress supporting the <br />project, that this is a case where there are no problems and Dickenson has <br />made an effort to comply with City requests by going to a Type I construction. <br /> <br />Mr. Schnelle pointed out that Staff is saying that there are no signed plans, <br />a Board of Adjustment is required to grant a variance and easements have not <br />been obtained. <br /> <br />Mayor Gamec inquired if a building permit could be granted on the contingency <br />that the above mentioned items are met. <br /> <br />Mr. Goodrich ~eplied that the City could, the Council cannot agree not to conduct <br />a public hearing.
