Mayor Gamec commented the music ending at 11:00 p.m. seems reasonable on a Saturday night. <br /> <br />Councihnember Pearson asked how many noise complaints there were the last time Diamond's <br />bad a live band. <br /> <br />Police Chief Way there were some complaints, for the most part people just wanted to know <br />when the music would be over. If the time is set at 11:00 p.m. it will have to be over at that time. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to authorize the Special <br />Events Permit to Gary Gruber, Diamonds Sports Bar and Grill for an outdoor music concert to be <br />held on Saturday night, June 19, 2004. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Kurak, Cook, Pearson, <br />Strommen, and Zimmerrnan. Voting No: None. <br /> <br />Case #5: <br /> <br />Request for an Interim Use Permit to Allow for Outside Storage of <br />Commercial Equipment in the Front yard of a Residential Property; Case of <br />Jeff and Barbara Rockow <br /> <br />Community Development Director Frolik explained the City received a complaint in April 2003, <br />regarding illegally stored trailers at 18015 Ute Street NW. The Rockows were sent notification <br />of the violation and were informed of what needed to be done to comply with City Code. The <br />Rockows did clean up the area where the trailers are being stored. This included removing all <br />the scrap aluminum from the property (it was being stored in one of the trailers), moving the <br />stack of fire wood, and storing other items indoors or removing them from the property. <br />Furthermore, the Rockows did install five evergreen trees along Ute Street as an attempt to <br />screen the trailers fi'om properties across the street. <br /> <br />Community Development Director Frolik explained the trailers were still being illegally stored in <br />the fi'ont yard and the Rockows were informed that the trailers either needed to be relocated on <br />the property to comply with City Code, stored indoors, or removed from the property. Due to the <br />topography of the site it was not feasible to relocate the trailers. Eventually, Mr. Rockow agreed <br />to construct a detached garage to house the trailers in an attempt to resolve the matter. However, <br />a variance and a conditional use permit were needed to accomplish this. During the public <br />hearings for these requests it was noted that Mr. Rockow could apply for an Interim Use Permit <br />to allow for the continued storage of the trailers in their current location. <br /> <br />Community Development Director Frolik advised that the Planning Commission held a public <br />hearing and reviewed the request for an interim use peri'nit on March 11, 2004. There was no <br />citizen opposition during the public hearing; however, the City did receive a letter, dated March <br />8, 2004, opposing any business or commercial use on this residential property. At this meeting <br />staff recommended that the interim use permit be approved without any major site <br />improvements, such as fencing or a minimum parking surface, which could encourage a future <br /> <br />City Council/March 23, 2004 <br /> Page 11 of 26 <br /> <br /> <br />
