properties of the same class in the same taxing district, as evidenced by sales ratio studies for said <br />other properties, by valuing said other properties at less than their actual market value, while <br />Petitioner's Property was valued by the assessor at 100%, or more, of the real or actual market value <br />and was thus valued unequally as compared to said other properties, resulting in an unequal share <br />of the tax burden being cast upon Petitioner's Property in violation of Minn. Const. Art. 10, <br />Section 1, and U.S. CONST. Amend. XIV. <br />COUNT III <br />1. Petitioner realleges the allegations contained in paragraphs 1 and 2 of Count 1 and <br />Count 2. <br />2. The Assessor for the City of Ramsey, County of Anoka, for the January 2, 2005 erred <br />in the classification of Petitioner's Property as taxable, whereas the Property is exempt from taxation <br />as an institution of purely public charity, under Minn. Stat. 272.02 subd. 1(6), and Minn. Const. Art. <br />10, § 1 and a public hospital under Minn. Stat. 272.02 subd. 1(3) and Minn. Const. Art. 10, § 1. <br />WHEREFORE, Petitioner prays that this Honorable Court will makes its Order: <br />1. Directing the appropriate authorities of the City of Ramsey, County of Anoka to <br />correct the tax list and assessment rolls pursuant to Minnesota Statutes Section 278.09, in accordance <br />with said determination of exemption, and directing that they issue corrected tax statements <br />reflecting such change in classification, and directing that appropriate abatements and/or refunds of <br />tax be made, together with interest as required by law. <br />2. Determining the real or actual market value of Petitioner's Property for the <br />assessment year 2005 that is not exempt from taxation. <br />3. Directing the appropriate authorities of the City of Ramsey, County of Anoka to <br />correct the tax list and assessment rolls pursuant to Minnesota Statutes Section 278.09, in accordance <br />with said determination of market value, and directing that they issue corrected tax statements <br />Allina\ana0420061 2 <br />
