The Council discussed at length as to why the issue was originally brought forward. Staff <br />reported that they believed there were now steps in place to address those types of issues, which <br />was not the case a couple of years ago. <br /> <br />4) Storm Water Utility Fund <br /> <br />City Administrator Norman stated that at various times in the past, the City has discussed the <br />stormwater utility fund. Most recently the City Council directed staff to begin negotiations with <br />property owners in the Mississippi Storm Drainage Sub-District No. 1 who are willing sellers. <br />This topic has been on the list of work session topics for a length of time and staff was seeking <br />direction on how the council desired to proceed with the topic. <br /> <br />Councilmember Kurak inquired if at some point the amount that is being charged to the business <br />will be reduced since they are paying a majority of the cost. <br /> <br />Assistant Director of Public Works Olson explained that staff is running into a problem with <br />calculating the charges for townhome units because it is extremely cumbersome and quite frankly <br />staff does not feel it is adequate. The second issue he wanted to address with the Council had to <br />do with situations where there was previously a business and home located on the same piece of <br />property so they were charged half residential and half commercial, but now the business no <br />longer exists. Staff was looking for a consensus if that property should now be charged only the <br />residential rate. <br /> <br />Mayor Gamec inquired as to where the City would make up the amount the City would lose. <br /> <br />Assistant Director of Public Works Olson replied that the City would probably be lowering rates <br />before they would be looking at increasing them. <br /> <br />Councihnember Cook inquired if it was possible to reduce the commercial rates first since they <br />are paying a large amount of the cost. <br /> <br />Assistant Director of Public Works Olson replied that they could look at creating a new formula, <br />but when they discussed the issue years ago they did a lot of research and the amount the City is <br />charging the commercial businesses is a lot lower than what other communities charge. <br /> <br />Councilmember Elvig inquired if there was any way to tie commercial/residential uses to a <br />conditional use permit. <br /> <br />Assistant Director of Public Works Olson explained that a lot of these situations are non- <br />conforming uses that have been grandfathered in. <br /> <br />Councilmember Cook stated that if someone is no longer running their business they should only <br />be charged the residential rate. <br /> <br />City Council Work Session/February 17, 2004 <br /> Page 6 of 8 <br /> <br /> <br />
