5 <br />Regular <br />Council 9/13/76 <br /> <br />Status of Odegaard dog situation. <br />Attorney Goodrich said the Odegaard's were scheduled to have <br />a public hearing for a conditional use permit to operate a kennel. <br />At the public hearing they said they did not feel they had a kennel <br />according to the dog ordinance. He said an amendment regarding <br />changing the kennel part of the ordinance was directed last summer <br />in June but was never passed. <br /> <br />Mr. Goodrich said that this could be prosecuted as a public <br />nuisance under State Statute and Civil Statute. Action may be <br />brought by any person and he will contact persons in the area <br />and ask if they desire to bring criminal complaint. <br /> <br />After the amendment is passed, action can be taken requiring them <br />to get a kennel permit or remove the dogs. These are the tools <br />available to help solve this problem. <br /> <br />Mr. Goodrich said he drafted the dog ordinance i~amendment based on <br />language from the Council in June 1975. <br /> <br />Mayor Cox read a letter to the Odegaards from Mr. Walker giving <br />them 10 days to remove the dogs. <br /> <br />Attorney Goodrich said that the Odegaards then requested a public <br />hearing and at the hearing declared they did not have a kennel <br />and therefore had no need of the hearing. They said they were not <br />taking fees for boarding nor training dogs. <br /> <br />Mayor Cox said there are people who can testify that they have <br />shot dogs and have seen people bring dogs there and Odegaards <br />have put them in their garage. <br /> <br />Attorney Goodrich said Council would have to rely on State Statute <br />on Nuisances. <br /> <br />Darla Walton said at one of the meetings, Mr. Odegaard admitted <br />boarding dogs but that he would not do it anymore. <br /> <br />Mr. Morley said Odegaard told him he had sold a dog for $400 and <br />he sold a dog to his daugh'ter in law's sister for $20. He has <br />had as many as 35 dogs there by his own admission. In order to <br />care for that many dogs he would have to had some financial assistance. <br />He has been a member of the Minnesota Breeders Association for two <br />years. It is simply a kennel, dogs howl, and when entertaining the <br />odor is so bad his guests cannot stay outside. This is the fourth <br />time in two months neighbors have been at meetings in regard to this <br />situation and they are sorry they did not do something right away. <br /> <br />Ms. Bento, 17735 Erkium, it is not established that these dogs <br />are huskys, they howl and sing, she has been awakened once or <br />twice in the same night by the noise. <br /> <br />J. Tilldry, 17725 Flourine, said he filed a complained two weeks <br />ago with Anoka police and could not get in touch with the Ramsey <br />police on the weekend. <br /> <br /> <br />
