Regular Council Meeting <br />December 13, 1976, Pg. 3 <br /> <br />in the area will create a need for sewer. <br /> <br />Phil Nereson said this is a temporary thing, it is not law, it merely gives <br />persons like Bernie Steffen a tool with which to bargain if the City's intent <br />is one way or the other. <br /> <br />Mayor Cox said he feels like the Council is telling people that have had land <br />for many years, keeping it rural for people to appreciate and enjoy, that they <br />cannot build on 2½ acres. He can't see getting in line with Metro Council because <br />it is unjust and undemocratic. <br /> <br />Motion by Gorham, seconded by Reimann to adopt Resolution No. 29 (#2), estab- <br />lishing 5 acre minimum lot size in the Transition Area, and 5 acre minimum lot <br />size in the Rural Area with a density not to exceed four housing units per 40 <br />acres with bituminous road surfacing, underground utilities in Transition Area <br />all provisions in the platting ordinance being required in the Transition Area. <br /> 2 Ayes <br /> Cox Naye <br /> Mickelson Naye <br /> <br />Councilman Mickelson remarked that with the amount of lowland in the Transition <br />Are~ and 75% of the land area already developed he doesn't feel 5 acre minimum <br />lot size in that area will solve the problem. <br /> <br />Motion by Cox to adopt proposal #3, Resolution No. 29, establishing 2½ acre <br />minimum lot size in Transition Area and 5 acre minimum in Rural Area leaving <br />4 housing units per 40 acres in the Rural Area, bituminous surfacing in Rural <br />Area and underground facilities. <br /> <br />Motion died for lack of second. <br /> <br />Councilman Mickelson disagreed with the motion because having a blacktop requirement <br />in the Rural Area will drive developers into the 2½ acre Transition Area. <br /> <br />Motion_ by Mickelson, seconded by Cox to adopt Resolution No. 29, #3, establishing <br />a 2½ acre minimum lot size in the Transition Area and 5 acre minimum lot size <br />in the Rural Area, with density in the Rural Area not to exceed four housing <br />units per 40 acres, as indicated in the Urban Planning District Study Report, <br />new subdivisions within the Transition Area will be required to provide bituminous <br />street surfacing and underground utilities, which will be more restrictive than <br />new subdivision within the Rural Area, Council directs these lot sizes and <br />restrictions, along with other appropriate subdivision controls, be implemented <br />into future planning projections. <br /> 3 Ayes <br /> Gorham Naye <br /> <br />New Busines. s <br />Variance request of Mr. Irving Ranney. <br />Mayor Cox read Planning & Zoning recommendation. <br /> <br />Mayor Cox told Mr. Ranney that the surveyor he contracted with has sat in on <br />all meetings of P & Z when the City was establishing ordinances and had much <br />input and he advised him in an erroneous manner, however, he said he would go <br />with P & Z recommendation. <br /> <br />Councilman Gorham said Council will have to establish a better method of handling <br />these situations. <br /> <br /> <br />
