Rezoning on Highways 5 and 47: Mr. Alfred stated he had received a <br />~etter from Mr. Goodrich sYating that the motion on this rezoning <br />at the last meeting had not passed. That letter dated April l, 1975 <br />is attached to these minutes. He explained about Statute 462o01 and <br />that the law has been amended since 1965. In his judgement a vote <br />of three to one under the new law is adequate. He is, however, <br />asking the Council to take another vote on this rezoning question. <br />Mr. Gorham said he pointed out at the last meeting that he did not <br />have a conflict of interest but in order to not get the Council <br />into a legal question, he has sought the advice of the Attorney Gen- <br />eral. Mr. Gorham read the letterer. Goodrich had written to the <br />Attorney General about this matter to get an opinion. Mr. Goodrich <br />had talked to Mr. Mike Gallagher today and his opinion is that Mr. <br />Gorham had no conflict of interest in this matter and the opinion <br />is being sent out today to that effect. Mr. Cox moved that this <br />proposed area be rezoned from r-1 to b-2 ~hi'c~ 'co~Prises approxi- <br />mately 90 acres as proposed by Royal Esquires:Realty, Inc. for the <br />following reasons: that it is centrally located in the community <br />with good access; it would fit in with our comprehensive plan, we <br />need the tax base in our community; it will conserve energy; it <br />will provide jobs for our residents; and as our ordinances stand <br />presently, we have no restrictions against residential in this par- <br />ticular area; and also complies with all the requirements as I see <br />them to fit in with the Metro Council plan for three plus square ~ <br />miles of commercial and industrial development; it also fits in with <br />the ideas of the many agencies with whom this matter has been dis- <br />cussed and the proposed 2030 year sewer district. Seconded by Mr. <br />Mickelson. Mrs. Oliphant stated Mr. Cox was out of order. Mr. <br />Goodrich stated he was not by the Revised Roberts Rules of Order. <br />Mr. Oliphant wanted to know if this deed of sale was made to Royal <br />Esquire Realty, Inc. He wanted to know if Joan Gorham was a di- <br />rector of this company. He wanted to know if Royal Esquire Realty, <br />Inc. was purchasing the subject property on a contract for deed. <br />He asked what would happen if the Royal Esquire Realty, Inc. de- <br />faulted on the payment for the land. He was told by Er. Alfred <br />that Joan Gorhamwas not a director of the company. Mr. Klammer <br />read a letter from Mr. Erling Johnson, dated April 10, 1975, con- <br />cerning the rezoning of land south of 152nd Ave. about traffic <br />that might be generated by a shopping center. Mr. Kurt Jenkinson <br />asked if Royal Esquire Realty, Inc. had taken this plan to the MC. <br />Mr. Albert stated it could not be taken to the MC until it had been <br />given approval by the local government. Mr. Cox stated we have <br />1800 parcels of land that could be built on at this time. He toured <br />with the School District at the time they selected this site on <br />Highway 5 and this 120 foot road was in use at that time. They <br />looked at Sites that were off heavily travelled roads and they <br />decided on the one on Nowthen Blvd. Mr. Larsen is concerned about <br />the traffic hazard. 153rd is not directly across from the school. <br />The question was called: Mr. Cox, Mr. Gorham, Mr. Reimann and Mr. <br />Mickelson voted yes. Mrs. Oliphant voted no. The motion carried. <br /> <br />Mr. Alfred said he would sit down~With'any~city)!~ommittee to pick <br />out a location for municipal buildings. He would like a branch <br />'public library, a small theatrical facility so J the community can <br />expand culturally. <br /> <br /> <br />
