Assistant Public Works Director Olson noted nothing is allowed in the right-of-way, and anything in this area would be able to be removed. City Attorney Goodrich advised anything on private property could be a taking. That would need to be weighed with safety concerns. Councihnember Elvig noted the committee discussed that trees will need to be trimmed to a certain height, and this would not necessarily require taking a tree down. Motion by Councilmember Elvig, seconded by Councilmember Pearson, to introduce an ordinance establishing the creation of a vision triangle into Chapter 9 of City Code. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Pearson, Kurak, Strommcn, and Zimmerman. Voting No: None. Absent: Councilmember Cook. Case #12: Consider Amending the Method for Calculating the Rate for Townhomes in the Storm Drainage Utility Civil Engineer II Linton explained on November 23, 1999, the City Council introduced an ordinance creating a storm drainage utility. The utility was adopted on January 11, 2000. On June 27, 2000, the City Council adopted a resolution establishing the storm drainage utility fees by amending the 2000 schedule of rates, fees and charges. The City Council adopted a resolution modifying the Residential Equivalent Unit (REU). Civil Enginecr Il Linton explained the storm water utility has been operational since 2000. The rate for townhouse developments was determined by treating the site like a business/retail/industrial site. The gross area was calculated, the impervious area was calculated, the REU factor was determined fi'om these numbers then the total charge was divided by the number of dwelling units in the development. The list generated of the affected addresses did not always get transfen:ed to the billing at Connexus. Recent review of the billing indicates that most townhouse developments have units that are charged the standard single family rate while adjacent units are charged at the rate determined for the development. Council discussed this issue at the February 17, 2004 work session and reached consensus to charge all townhome units a per unit residential charge. Consensus was also reached that if a property owner no longer operated a business on the property then they should only be charged a residential rate. Mayor Gamec asked if Connexus will be notified of the change. Civil Engineer II Linton responded in the affirmative. Mayor Gmncc asked when the ordinance would take effect. Civil Engineer II Linton replied the ordinance would come back for adoption on April 27th and would take effect on May 30th. City Council/April 13, 2004 Page 29 of 33
