Case #12: Application for Motor Vehiele Sales and Repair Lieense~ Case of SR Auto <br /> <br />Community Development Director Frolik reviewed that on April 13, 2004, the Council <br />considered an application fi'om SR Auto for a motor vehicle sales and repair license that had <br />been placed on hold by the Community Development Department in order to resolve some code <br />compliance issues. The issues have been resolved with the exception of the outdoor storage area. <br />The new H-1 Highway requirements state that outside storage areas must be paved with <br />bituminous or concrete. SR Auto and the property owners are requesting a waiver for two <br />reasons: 1) the storage area will be 100% screened and the type of surface inside the enclosure <br />will not be visible to the public; 2) the property currently has no hard surface improvements and <br />is considered lawful non-confolTning; the applicants state that it does not seem logical to pave a <br />storage area when the vehicle display area does not have to be paved. <br /> <br />Councihnember Cook noted another reason not to require the paving is that this is in the official <br />mapping area for Highway 10. <br /> <br />Motion by Councihnember Cook, seconded by Councilmember Pearson, to approve SR Auto <br />application for a motor vehicle license contingent upon providing a 55' x 6' enclosure for <br />outdoor storage by June 30, 2004, and providing the City with a surety in the amount of <br />$2,400.00 to ensure compliance with the license contingency. <br /> <br />Further discussion: Councilmember Kurak questioned how inspections will be addressed. She <br />exprcsscd concern that the fluids are not always drained from the cars. Community Development <br />Director Frolik replied inspections would be allowed by Fire Inspection, as there was a fire here. <br />The applicant understands his requirements with the county now, and the county has the authority <br />to go onto the property and inspect. Staff is proposing a surety to ensure the fence is put up in a <br />timely manner. Mayor Gamec returned to the meeting at 9:33 p.m. Councilmember Elvig <br />stressed the need to make sure the landowner and the business owner understand the City has the <br />authority to go onto the property for inspections. Radu Kryshmaru, Owner of SR Auto, replied <br />the landowncrs arc aware of this and he does not have any problems if the property is inspected. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Pearson, Elvig, Kurak, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #13: <br /> <br />Cousider Adopting Policy Relating to the Construction of Sound Walls along <br />County Roads <br /> <br />Assistant Public Works Director Olson stated during the review of the Alpine Woods <br />Subdivision, staff was directed to draft a policy relating to the construction of sound walls along <br />county roads. After doing research, staff found that Minnesota Statute 116.07 Subdivision 2a <br />excmpts roadways under county jurisdiction fi'om the State Noise Standards unless the roadway <br />has fidl access control. The policy that has been drafted references this statute.
