but since that time the developers have included land area with±n the Critical Area designation and the city has to abide by the ordinance on the Critical Areas and the city doesn't have E.Q.B. approval~ The developer asked if he could get approval if he would leave out the land area within the CriticalArea. City Attorney Goodrich informed the developers that the city still has not received the abstract or the escrow. Mayor Gamec informed the developers that they don~t have preliminary approval yet, but they could come in with the preliminary and final approval requests the same day. City Attorney Goodrich explained that the only thing the developers can do is sell the lots, but the buyers cannot get a building permit unless the improvements are in. The developer asked if the escrow would go off when the streets are in. Mayor Gamec said the escrow would go off when the street are in. The developer asked if he could hold off on blacktopping until 75% of the lots are developed because construction might hurt the blacktoPPing~ He asked if they could just gravel the streets. Mayor Gamec told him to put the request in his proposal. City Engineer Raatikka informed the developer that there is a water problem on the urban street which would wash out the gravel and before they could blacktop, the gravel would have to be redone. The general consensus of the council is that the area should all be blacktopped. The developer asked if the blacktopping would be escrowed. Mr. Burt Chelton, developer, said the whole purpose of escrow is for security for the city and he said he would like to be able to sell some lots before blacktopping. Mayor Gamec informed him that the lots can be sold before blacktopping, but no building permits would be issued until all the improvements are in. The developer said they were discussing putting in condominiums or townhouses or quads on the lots to the south of Riverdale and he wanted to know if these would be allowed. Mayor Gamec explained that presently only single dwelling houses are allowed~ but the city is looking into other type housing now.
