The resident said the road has never been maintained by the city and now he has to pay for the upgrading of it. Mayor Gamec explained the city looked at it as a private driveway, but a permit should not have been issued without upgrading. He told the resident that at the time of the assessment, a decision would be made on whether he would be assessed or not. He said there could possibly be two assessments on the two property owners there because they would benefit mope. The resident noted that for eight years he had been paying taxes and did not get any benefits and he asked if he would get his taxes back. Mayor Gamec said no he wouldn't get his taxes hack. Councilman Cox asked the resident what he would prefer. The resident said he wanted it blacktopped and he couldn't see that it is benefiting him the same as the rest of the people. He asked if there was going to be a cul-de-sac at the end of 17?th so they can plow. City Engineer Raatikka said the city is going to put a small turnaround there. City Attorney Goodrich suggested hiring an appraiser to go out there before the project is begun. Discussion was held on hiring on appraisal of this project. Councilman Cox noted that if the city proceeded with the whole project and left out that area, the residents could come in down the line and demand the city to take care of their street. City Attorney Goodrich noted if there is a fire back there and the city can't get to it, the city would be open to liability. This is a city-accepted street and the city has an obligation. Councilman Cox said he saw water sitting in the road there and it appeared to him something has to be done and he does see the responsibility on the city's part. Motion by Councilman Cox and seconded by Councilman Mickelson to adopt Resolution #80- 57 Ordering Improvement and Preparation of Plans and Specifications, Street Improvement Project (177th Avenue N.W., 178th Lane N.W., 179th Avenue N.W., Salish Circle, Tonto N.W., and Yakima Street N.W.) and to hire an appraiser to review the properties before construction and see what the benefits would be to the two property owners south of 179th & Yakima. Motion carried. Voting yes-Mayor Gamec, Councilmen Sorteberg, Reimann, Mickelson and Cox. Voting no-None. Please refer to resolution file for Resolution #80- 57. Mayor Gamec told the resident that at the Assessment Hearing he would find out what his assessment would be and he could appeal it to District Court if he differed with what the council determined.
