Much discussion followed on the proposed amendment.

Councilman Sorteberg suggested tabling this issue to give the council members
more time to do more research on it.

Motion by Councilman Cox and seconded by Councilman Mickelson to table
approval of Amendment to Section 170.038C Paragraph (7) of Chapter 170.03
of the City Code until the Regular Council Meeting of November 11, 1980.

Motion carried. Voting yes-Councilmen Reimann, Sorteberg, Mickelson and Cox.
Voting no-None.

3) Request for Variance from the City Subdivision Code 170.03 to Build a

Second House on a 10-Acre Parcel of Land; Case of Mr. Raymond Mox

An attorney was present representing the Mox's. The attorney said somewhere
along the line there was a misunderstanding of what the Mox's actually wanted.
They want to keep their ten acres on the farm and in the family. When they
applied for a building permit, they were to~ that they needed a survey and
they decided it was too expensive to do a survey. They are not asking for
a variance, but a waive on the survey.

City Administrator Schnelle said they have one house on a 10-acre parcel now.
The City has never run into this situation before where the City has allowed
another house on a parcel that already has one.

City Attorney Goodrich said the City can't require a Park fee~ if there is no
subdivision.

The Mox's attorney said that the Mox's understand if they want to sell either
house or both that they will have to comply with all the requirements.

Mr. Mox said there will be no mortgage on this.

Councilman Reimann asked if they would have any objections to where the house
would face as the City wants to limit accesses onto the thoroughfares.

The Mox's attorney said there is no intention at this time to subdivide the
property. He recommended to the Mox's that they work with the City as far as
location of the house.

Councilman Reimann said the City is trying to save them problem in the future.

City Attorney Goodrich said the council may want to make a policy in the future
that states there should be only one house per lot of record.

Councilman Sorteberg noted that this is a very unusual case being there is no
mortgage involved.

City Attorney Goodrich was instructed to pmepared a contmact and findings of
fact for the regular council meeting of October 14, 1980.

The council meeting recessed at 9:20 p.m.

Special Council
September 30, 1980
Page 4
