Board Member Brauer asked what would happen if they denied the request. <br /> <br />Associate Planner Wald indicated the applicants could not build, however they could appeal to <br />the City Council. <br /> <br />Vice Chair Van Scoy stated he is wondering about their ability to deny the request since the lot is <br />consistent with the surrounding lots. <br /> <br />Mr. Bouta indicated he owns both lots in question and the adjacent lot. He stated the lot has been <br />on the record for the last 25 to 30 years, and everyone that has bought in this neighborhood knew <br />it was a lot of record. He indicated in September of 2002 his intention was to build on the lot <br />himself, and he brought his idea to Community Development Director Frolik, who talked to the <br />City Attorney. He was told as long as the setbacks were met and he could meet the septic <br />requirements they would issue a permit, so he thought he was in good shape, however now he <br />has found out he is 5.29 feet short off the 200' requirement at the street. <br /> <br />Vice Chair Van Scoy asked about the comment in one of the letters about a driveway to the pole <br />barn. <br /> <br />Mr. Bouta indicated he has already made an access to the pole barn on the other side of his <br />property. <br /> <br />Wendy Rahn, 16865 Sodium St. indicated she lives across the street. She wants to make sure <br />this will be a single-family dwelling. <br /> <br />Associate Planner Wald stated that was correct. <br /> <br />Nanette Sorenson, 16868 Sodium St. indicated as far as access to the pole building goes, she <br />does not think the road on the other side of the property is within the lot line as far as it needs to <br />be. She feels the driveway needs to be looked at further. She stated if Mr. Bouta wants to cut off <br />access to his pole barn it is his prerogative, but there would not be a drivable access. <br /> <br />Vice Chair Van Scoy asked if there was a requirement on how far off the lot line the driveway <br />must be. <br /> <br />Associate Planner Wald stated it has to be five feet or more from the property line. <br /> <br />Board Member Johnson suggested they should rely on Staff to make sure the new driveway is <br />acceptable. <br /> <br />Vice Chair Van Scoy asked if Staff has any concerns with the new driveway. <br /> <br />Associate Planner Wald indicated they do not. <br /> <br />Board of Adjustment/April 1, 2004 <br /> Page 4 of 8 <br /> <br /> <br />
