Community Development Director Frolik stated the applicant has submitted a Grading and <br />Erosion Control Plan that proposed to modify the drainage patterns from the site. She indicated <br />this development proposes to collect runoff from the expanded development and direct it into a <br />storm water pond located on the northwest comer of the site. She stated this detention pond <br />would provide removals of 98% and 93% of National Urban Runoff Program standards for total <br />suspended solids and total phosphorous, respectively. She noted the City Engineer has indicated <br />the new drainage plans would improve the site over what is happening now. She indicated the <br />DNR would need to approve the drainage plan, and would have 30 days to do so. <br /> <br />Board Member Johnson asked if Staff has received feedback from the Rum River Water <br />Management Organization. <br /> <br />Community Development Director Frolik stated they have, and Rum River has approved the <br />application. <br /> <br />Public Hearing <br /> <br />Dan Olson, 13747 Dolemite, stated he wants to address several issues, starting with the drainage <br />and run-off. He indicated he would disagree with the statement that 98% of the run-off will be <br />contained on the property. He presented photographs of the subject property and his property, <br />noting they had to install shoring in their yard to prevent mn-off from the subject property. <br /> <br />Mr. Olson indicated that with the grading on the south portion of the Superbowl, 10 to 15% is <br />going toward his property to a detention pond on the north end. He stated it is quite evident there <br />will not be a remediation affect for his yard. He indicated the other issue is they are proposing to <br />have parking on the south side of the Suberbowl, which makes increased potential for damage to <br />his fence. He stated with the spaces behind the Superbowl people will likely be backing into the <br />space. He advised a track bed is typically three and a half feet, and unless they have curbing far <br />enough away, he wonders what will happen to the fence after someone has been drinking for a <br />few hours. <br /> <br />Mr. Olson presented a photo showing the grade from the Superbowl to his property, and another <br />demonstrating the view of Superbowl from his dining room. He stated when you take into <br />consideration the grade is higher, they will get headlights over the fence. He indicated he does <br />not know when the new owners took over, but it appears they are doing something right because <br />the place is packed every night, even on weekdays when it was not before. He stated they will <br />have headlights shining into their dining room late into the night. He indicated the last photo is <br />another view from his deck, where you can see the back side of the fence they put up. He stated <br />he would add that whatever they do as they put in a parking lot would be an improvement over <br />the last six or seven years. <br /> <br />Vice Chair Van Scoy stated they appreciate Mr. Olson's comments. He indicated this is a two <br />step process, and the first is for them to deal with the impervious surface.
