Regular Meeting <br />March 28, 1977 <br />Page 4 <br /> <br />MOTION by Gotham Seconded by Mickelson to approve the plat of Forest Hideaway <br />and to enter into a contract with the developer. Said contract to be in <br />accordance with the engineers recommendation. <br /> <br />Mr. Bob Zelenak, who was appointed to District ll Advisory Council was <br />present. He said he is new to this and plans to mainly observe and <br />correlate information to Council. Mayor Cox emphasized that Council is <br />primarily concerned about the Community School Program being for the youth. <br />He commended Bob on his outstanding job working with children. He said it <br />is very appreciated, and he thanked him for accepting the job. <br /> <br />Duke Grosslein, variance request. <br /> <br />Attorney Goodrich said Mr. Grosslein and Dickenson and people from the neighbor- <br />hood are here concerning the proposal. Mr. Grosslein wants a variance adjacent <br />to parcel 1480 to set closer than 20 feet to the lot line. The City has <br />maintained this parcel for six years and State law says that any roadway/ <br />cartway kept by the City for more than six years becomes public, that would be <br />measured 33 feet from the center of the road. However, recent supreme court <br />ruling says it may include only the traveled portion which may be only 20 <br />feet and may include ditches. He said if Grosslein is granted this variance <br />he will be out of parking space and will .have to park on the southerly part <br />of his property which is R1. Part of the lot is commercial and part is <br />residential. <br /> <br />Mr. John McGiven, Attorney for Dickenson asked about the request. <br /> <br />Mr. Nereson said Mr. Grosslein went to P & Z then to Council. Mr. Nereson <br />explained the Council's action at the last meeting. <br /> <br />Mr. Grosslein said he would like to go up to the property line with a 20' <br />addition onto the cooler and dock loading sections. <br /> <br />Mayor Cox asked for Council consensus~ <br /> <br />Councilman Reimann feels it should be denied, that the City should adhere to <br />the ordinance, he feels the reason for the ordinance was to maintain orderly <br />devel opmen t. <br /> <br />Councilman Gorham read the motion of the last meeting concerning Grosslein's <br />request. <br /> <br />Mayor Cox asked for a motion to do other than what the original motion called <br />for. <br /> <br />No motion was offered, original motion stands. <br /> <br />Merle Anderson said he did not receive any mailed notice of a variance request. <br />Mr. Nereson said the variance procedure did not require mailed notices. <br /> <br />Mr. Anderson said he and others in the residential area were all rezoned and <br />went through an exercise in bureaucracy to get it reversed back to residential. <br />He said they wanted it all put back to residential but had to live with the <br />compromise. He feels the residents are opposed to expansion in the Rivlyn Avenue <br /> <br /> <br />
