Regular ~¢eeting <br />August 22, 1977 <br />Page Three <br /> <br />I,':ayor Cox explained to ~!r, ~.!enkveld that Ramsey is anxious to enter into an <br />agreement with him for if this enters., into a condemnation, it will cost him <br />as well as the City alot of money. But, he explained, that if an agreement <br />is not reached soon, the City will start condemnation proceedings. <br /> <br />It was decided then, that there are four undecided questions left to be agreed upon. <br /> <br />1. that the land be exclusively residential, industrial or mobile home, <br />2. termonology of now existing or then existing ordinance. <br />3. relocation or moving of the septic tank. <br /> road alignment. <br /> <br />After discussing with his client, Mr. Nenkveld, Mr. Neilson said_ that I~r. _~enkveld <br />will agree to the following: <br /> <br /> 1. As far as the use in Section 28 where zoning can be of three different <br />things, ¥.r.F. enkveld agrees that if he starts it one way, it w~[1 all be that way. <br /> <br /> 2. Re. the hold harmless agreeEent. Nr. Nenkveld does not want to move <br />the tank himself and he believes that the County of Anoka will move it anyway <br />and does not agree to the hold harmless agreement. <br /> <br /> 3. ~r. }~enkveld wants the road alignment according to the diagram as pre- <br />pared by the City Engineer. <br /> <br /> 4. ~r. Nenkveld will agree with wording of then existing ordinance; however, <br />but wants it worded so that in the event of future ordinances this land in Section <br />28 can still be reasonably developed. <br /> <br />Attorney Goodrich said that it should say that it will not be treated any <br />differently than all other lands. ~r. l,~,eilson said, and that it is at that time <br />developable, The Council was agreeable to this. <br /> <br />~',"OTION by Gamec, Seconded by Reimann, to accept the agreement as presented with <br />the conditions that: 1. of the uses, industrial, residential/ or mobile home park, <br />that once ~t is started one way, it will be continued that way~ 2. that the septic <br />system ordinance as in effect at the time of development be used~ 3. that the <br />road alignment be straight in the North 120' of Section 28; 4. that thc tank be <br />removed out of the right of way by the City or County with no liability to the <br />County or City with the approval of the city attorney and with the exclusion of <br />F, xbibits ~,' ~ G in Paragraph 9. 5 Ayes <br /> <br />~OTION by ~.;ickelson, seconded by Muller to adopt Resolution ~43 determining the <br />necessdty for and authorizing the acquisition of certain property by proceedings <br />in eminent domain. 5 Ayes <br /> <br />Attorney Goodrich said he will redo and retype the agreement again and send it to <br />}4r. ~,!enkveld and his attorney asking if they will accept this agreement. <br /> <br /> <br />
