Regular Meeting
February 13, 1978
Page Four

7. Leland and Vicky Stull (Stull Addition)

Stull Addition was approved by the township board in 1974. Registration of
final plat is called for within 120 days for approval. The Stulls are asking
for reconsiderations on the addition by the City Council.

Carl Anderson of Hawkinson Anderson Assoc. was present and presented to the
Council the Stull's plan for the addition.

Mr. Nereson said the plat is null and void so it now is a question of if
this is a reasonable use of the land.

Vicky Stull was present and explained to the Council that they had at one
time gotten an okay to' build on one of the lots after a road was put in
and after the subdivision was done. She said they should never have had
to subdivide the land in the first place and was concerned over the
expenses they have incurred.

Leland Stull explained that they initially did not want to subdivide. They
wanted to build two houses on it. He said they found out they couldn't do
that so either J.o~n O'Donnel or he himself would build on it. He said he
paid cash for 2 1/2 acres and carried a contract for the remaining balance.
He said that at the time he wanted to do this Planning and Zoning said no
because if the financing went bad, the bank would repossess the 2-1/2
acres from the 16 and it would be split off illegally.

Mr. Nereson said that the point is if you have title to 2-1/2 acres which is
within a 16 acre parcel, it would require a subdivision to make it a separate
parcel which would require a variance from the ordinance or you would have
to plat. · ~r. Nereson explained to the Council that they cOUld do one of
two things -- approve a final plat for Stull Addition, or send it back to
Planning and Zoning for review for recommendations to the City Council.

After General discussion it was decided that the stulls take this back to
Planning and Zoning for their review and recommendations to the City Council.

8. Jerry Nelberg Temporary Mobile Home Permit

}~r. Nereson explained that a variance would now be required to allow Mr.
Melbergts trailer stay on the property as the extension in time has already
been allowed an~ was to be off by the 28th of February.

Jerry Melberg said he would like a six month variance. His attorney, Mr.
John Bergland, said to the Council that if they would grant a six month
variance the mobile home will be off the property at that time and ',we
will not be back in here for another request."

General discussion was held.

NOTION by Gamec to grant a variance that house must be up and moved into
within six months and mobile home has to be removed by Angust SO, 1978.

Notion died for .'~ack of second.
