Council
Page 4

Consider private "Off Sale" Licensing Ordinance

Attorney Goodrich explained that this particular drafting of the ordinance includes
off sale license-private (for clubs like the VFW) and an on sale wine license pro-
vision. He suggested that the Council also look at how many off sale licenses
the City would want to issue and the square footage of the off sale facility.
He also said that the Council should think about if they would care if an ex-
isting or future on sale licensee also had an off sale license. This item will
be placed, on the Agenda for the next Council meeting.

6. Consider Home Occupations and Assessory Use Issue

Councilman Muller read a memo from Mr. Nereson about home occupations taken from
the ordinance. There was general discussion, but Attorney Goodrich did say that
it is very important that the accessory use issue is defined very well. Attorney
Goodrich was directed to give this to the Planning Commission for their review.
Councilman Gamec suggested that the Planning Commission be directed to put some
of their findings down in writing for the Council's use. Attorney Goodrich said
that he would try to attend the meeting.

Jerry Bauer, Burns Plat

meeting was set with the Burns Township board for discussion.

8, Tree Sale, Arbor Day Report

Councilman Reimann reported on a ceremony held at City Hall by two 4-H Clubs
that participated in planting a flowering crab tree at the City Hall. It was
a very nice program with many participating in the ceremony. Noble Nursery
donated the tree. The tree sale a week ago Saturday was a very good sale.
Noble Nursery donated the trees also. It was decided to send a letter to the
4-H Clubs thanking them for their participation.

NEW BUSINESS

1. Building Permits - Klemish Addition, Peterson Estates, Klemish-Flores ~ddn.

Mayor Cox explained that there was some concern about what the building was going
to be used for and that a situation will exist that is now at the present Klemish
residence which is an unsightly situation.

Councilman Mickelson said that the staff was directed not to issue any permits
in this area and he said he thinks that is highly irregula~ .to ask' s~aff to do
something that is illegal. He said he does not go along with those kind of
actions whatsoever. He said that as far as this letter that was received is
concerned, no one asked him then why he abstained that night. He said it
states in the letter that Mr. Klemish has never had any problems with variances,
but Councilman Mickelson said that he has had as many as anyone. He said it also
states that no action was taken, but he feels that a favorable vote is action.
