claiming property devaluation, Council and staff have stated that the
burden of proof is on the property owner and not on the City.

Commissioner Shumway stated that Mr. Bauer has put a lot of effort into the
presentation; the property is zoned for industrial use; the Company seems
to be willing to go out of their way not to offend neighboring properties;
either way, granting the permit or denying based on resident objections,
the case could end up in court.

Chairman Peterson stated that he is concerned with the amount of truck
traffic there would be on County Rd. #56, north of the plant.

Mr. Sauer stated that the only time truck traffic would go north of the
site on #56 is to deliver materials needed on Ramsey area jobs; material
deliveries from Elk River would be transported on Hwy. #10 to Cty. Rd. #56
to the plant.

Commissioner Deemer expressed concern for accesses onto Cty. Rd. #56.

Commissioner Hendriksen inquired as to hours of operation.

Mr. Gary Sauer replied that actual operation of the plant machinery would
be from 7:00 a.m. to 4:30 p.m.; prepatory and repair work on the plant
machinery would be prior to 7:00 a.m. and after 4:30 p.m.; there may be
emergency occasions where the hours would vary.

Chairman Peterson ir~uired as to the condition the property will be left in
if the plant moves on to a new location.

Mr. Gary Sauer replied that the site plan addresses property end use.

Chairman Peterson stated that with respect to the proposed airport
improvement project, P&Z must function as if it were not a factor at this
time.

Mr. Gary Sauer stated that his firm is following the airport issue very
carefully; that he does not intend to spend a lot of money developing the
plant on his property just to make a larger profit if the airport project
is approved; noted that he also does not intend to delay his plans for an
indefinite period of time; if it appears the airport is going to be
approved, Barton Sand and Gravel will consider alternative locations.

Commissioner Hendriksen inquired as to projected heights for stockpiles and
structures.

Mr. Gary Sauer replied that stockpiles are planned for 30' in height; the
highest structure point would be 65' where conveyors come into the top of
the silos.

Commissioner Hendriksen inquired if Mr. Sauer would be willing to commit to
replacing anydying trees that are part of the screening with similar size
trees.

Mr. Gary Sauer replied that he would replace dying trees if intentions are
P & Z/March 3, 1987
