JAMES ACERS, 8600 -

I
i
I
I
I
I
I
I

176TH AVENUE NW:

Enclosure (D3-a) contains Mr. Acer's letter dated January 12, 1983 in which he
states that the City snow plow damaged decorative post at the edge of his driveway.

I have discussed this issue with Street Superintendent Mevissen and have gone
out and viewed it. Merle states that the posts are too close to the road and
the City should not have to replace them. I have to concur with Merle on this
issue. It should be noted that in a snow like we had when this accident happened,
you cannot see these posts. Also, it really damaged our wing on the truck which'
added more problems to our snow removal crew as it meant we had to stop and re-
pair the equipment durin9 a critical time. I have notified Mr. Acers that he will
be on the agenda so he will be present.

Council Action: Your action will be to approve/disapprove of Mr. Acer's claim
against the City. I suggest that Councilmembers review this case with Merle and
also go out with him and view the damage prior to this Council$.meetingo The
following proposed motions are hereby submitted for your consideration:

Motion Accepting Responsibility

Motion by~ and seconded b~to replace the decorative
on edge at Mr. Acer's residence at 8600 - 176th Avenue
post located eway
NW that were damaged by the City's snow plow truck on Thursday, December

30, 1982.

Motion carried: Voting yes
Voting no~,/.~/~~
