The City <br />could make it as a condition of said conveyance that the course <br />be kept open to the public. <br /> <br /> In this manner, the owners of the northerly parcels (Andersons <br />and Berglund & Dom) could justify reducing the number of lots, <br />because of a compensating deductibility for the charitable <br />contribution of land to the City. The City in turn can guarantee <br />completion of the project through performance bonds, and guarantee <br />that the course be held open to the public, by its conveyance to <br />Wesley Bulen. Wesley Bulen would have his land costs written <br />down to zero for that portion of land outside of his existing <br />parcel. In short, the procedure benefits all parties and is <br />critical to the success of this particular project. <br /> <br /> By way of information, Minnesota Statutes Chapter 465.026 <br />reads as follows: <br /> <br /> "Any municipality owning lands in fee simple and not <br /> restricted by the grant, may convey such lands for a <br /> nominal consideration to encourage and promote industry <br /> and provide employment for citizens." <br /> <br /> It should be noted at this point that the golf course and <br />facility itself should provide at least 6 to 12 new jobs. In <br />addition, a restaurant and lounge facility could provide up to <br />an additional 30 to 40 new jobs. Finally, the commercial por- <br />tion, which is tied critically to this Planned Unit Development, <br />would also provide additional employment for numerous citizens. <br /> <br /> It should also be noted that usage of the park land for golf <br />course activities would likely be recommended on a leasehold <br /> <br />-9- <br /> <br /> <br />
