Variance Re~est- V~q_t..gr M_astlev Mr. M,~;~;t].ey was pres~.nt with a r~-cuest from the subdivision ordi~sr~ce~ to allow him to subdivide by metes and bounds a narcel owned by Bertha Mae S~"itb and located ~t the northwest corner of 166th'Street arid Jz~spar Ctreet N.W. .Mr. Mastley presented'two:p!ans: for~the ~arcel.~ One plan ~:~owe~ three lots~ and ome.o!an calling for two lots. After discussion, ~ ~he co~a~-'~sus 0f the com~iss~on was to advise ,~'~astley that the p!~n calling for two lots was by far the more acceptabl~ since the other vlan in- ,]~cated one lot witho~t the rcouired number of feet on a public road. ~.1 Sort~d~erg stated that he would never approve the three lot split by metes and bounds v~itbout approved roads. Motion by Art Dunn~ seconded by A1 Sorteberg to reco~m~end to the City Council to ~rant a veriance to Victor Mastley to subdivide by Metes end bounces to the narcel presently owned by Bortha Mae Smith and being a oart of the Southwest Ouarter of the Sou[ht?es+. Quarter of Section 10, Tot,,'nsh-lp >2, Range 25~ into two oarcels of atgproxi~ately >.5 acrea each as ocr cert~ ficate of survey and subject to road ease~'ent of >>' on west t~roperty line and 40' on North property line, and payment of park dedication fee. Motion carried 6-0. I I I I I I I I I I M.r. Mastley was advised that the final decision would be made by Council and should not ~o ahead and purchase the property before he has Council decision. Item 4. Rezonin? reouest - Dr. T.W. Anderson Dr. Ton Anderson and Dr. Refer Austin were present with a request for rezon~ng of 5 acres located on the Northwest corner of 167th and #47 from R-1 to light commercial to allow the building of a dental office. Dr. Anderson explained that they had already talked with the Highway Deot. and they posed no objections, and they had received favorable comments from the neighbors in the area. It was stated that Dr. Anderson and Dr. Austin have operated a dental clinic in Coon ~apids with a septic system for 10 years without any problems. As the sketch preseFted for review left a ~.5 acre parcel undeveloped~ Ken Peterson explained that he wasn't opposed to the concept of the dental office~ but would like to see a plan for the entire acreage. Dr. Anderson said that they did. not want to invest any more than necessary unless there is rezoning. There was discussion of how the ~.5. acre parcel on #4? could be zoned so as to orevent undesire~ble development at a future date. It was exolained that ' · %he~ wou~d like to have the entire parcel rezoned from R-1 so as not to close the door on the future. The po.~s~blity of resDrictive covenants was ~]iscussed and a Public H~aring will be held on August 21.
