I I I I I I I I I I I I I I I I I PERFORMANCE CONTRACT WIT~ THE CITY OF RAMSAY THIS AGREEMENT, made and entered into the __day of , 1981, by and between the City of Ramsey, located in Anoka County, State of Minnesota, hereinafter referred to as the "City", and NoD.H., Inc., a Minnesota corporation, having its principal place of business at 700 Industry Av(~t~ue N.W., Anoka, Minnesota 55303, hereinafter referred to as the "Developer". WHEREAS, the Developer has applied to the City Council for a plat approval of the proposed plat known as Flintwood Hills Second Addition; and WHEREAS, the City Council has given approval of said preliminary plat; and WHEREAS, said plat is located within an area of the City which is likely to be served with sanitary sewers in the next two years; and WHEREAS, the Developer is required as a condition of the City's approval of said plat to enter into a contract binding it to perform certain acts and duties within a specified time; and WHEREAS, the City Council requires that said conditions be performed in a timely manner and a bond for the performance of said conditions must be filed assuring the City of full performance within the certain specified period of time; and W~EREAS, the Developer has agreed to perform said acts and duties in a timely manner; and WHEREAS, the City Council has agreed to and does gran% its approval to the Developer's plat known as Flintwood Hills Second Addition subject to the Developer's agreement to perform said acts and duties as are hereinafter set forth. NOW, THEREFORE, IT IS HEREBY COVEN~NTED AND AGREED, that the City Council has granted its approval to Flintwood Hills Second Addition plat, and the Developer has agreed to the following:
