20. That the Applicant has stated the smoker would produce an odor much like a typical <br />outdoor grill. <br />21. That the Applicant has stated their willingness to construct a wood fence around the back <br />area of the garage so that the smoker and exhaust vent are not visible from surrounding <br />properties. <br />22. That City Code Section 117-361, which governs the use of solid -fuel heating devices, <br />requires that exterior solid -fuel heating devices be located at least 75 feet from the property <br />line and not in a front yard. The distance requirement is intended to ensure that smoke <br />generated by the device has a chance to dissipate before reaching neighboring properties. <br />The proposed commercial kitchen' s smoker is expected to expel less smoke than a typical <br />solid -fuel heating device. The smoker's external components would be located in the back <br />yard and at a much greater distance than 75 feet from the nearest property line which is <br />over 200 feet away in the current proposal. <br />23. That based on the size of the Subject Property, there shall be no more than eight (8) items <br />stored or parked outside in accordance with City Code Section 117-355 (Residential <br />Development Off -Street Parking). <br />24. That there are no interior or exterior business signs or displays related to the Home <br />Occupation on the Subject Property. <br />25. That the Applicant has stated that there will be two (2) to three (3) roundtrips per week <br />affiliated with the Home Occupation as well as one (1) to (2) deliveries per month to the <br />Subject Property. <br />26. That the Subject Property is serviced by an individual well and septic system. <br />27. That the Applicant has stated that a commercial grease trap will be installed to capture <br />grease before entering the septic system. <br />28. That the commercial kitchen and all other home modifications relating to the Home <br />Occupation will adhere to the City's Building Code and Fire Code. <br />29. That the Applicant shall provide the City a septic design and management plan, prepared <br />by a licensed designer, subject to the review and approval by the City, to ensure that proper <br />modifications to the existing system are implemented or to verify that the existing system <br />has sufficient capacity for the Home Occupation. <br />30. That the Home Occupation does not constitute a fire hazard to neighboring residences. <br />31. That the Home Occupation does not include operations related to internal combustion <br />engines, body shops, ammunition manufacturing, motor vehicle repairs or sale. <br />RESOLUTION #16-01-012 <br />Page 3 of 5 <br />
