PUBLIC HEARING <br />6.01: Public Hearing to Consider Adopting Resolutions Related to the Final Plat for Rum <br />River on the Green; Case of Paul and Mary Johnson <br />Presentation <br />Community Development Director Gladhill reviewed the staff report and recommendation to <br />approve the easement vacation, contingent upon successful recording of the Plat; approval of the <br />Final Plat, contingent upon revisions outlined in the staff review letter dated April 22, 2016; and <br />approval of the Development Agreement contingent upon review and approval as to legal form <br />by the City Attorney. He noted there is a citizen in the audience that would like to speak to this <br />issue and find out what this means for his property. <br />Public Hearing <br />Mayor Strommen called the public hearing to order at 7:10 p.m. <br />Citizen Input <br />Bob Ford, 5531 164th Lane, stated he owns the property to the south. He said he is trying to <br />understand how the drainage easement will affect his property. He has a mound system on the <br />property, which is of concern. <br />Motion by Councilmember Riley, seconded by Councilmember Shryock, to close the public <br />hearing. <br />Motion carried. Voting Yes: Mayor Strommen, Councilmembers Riley, Shryock, Kuzma, <br />LeTourneau, and Williams. Voting No: None. Absent: Councilmember Johns. <br />The public hearing was closed at 7:20 p.m. <br />Council Business <br />Community Development Director Gladhill indicated this is the first he has heard of this <br />potential issue this evening. He said he will work with the property owner. The same easements <br />will go on the property to the north. He explained staff will look at the mound system and verify <br />it is properly constructed. This issue cannot be resolved as part of Council's action at this <br />meeting. This issue could be made a contingency in the motion. <br />Mayor Strommen responded she would feel more comfortable with a contingency. She said the <br />City recognizes there are old drainage utilities and easements, and would like to ensure this does <br />not cause issues.
