with the pop,ct. Soinc of thc propos~'d solutions have the pond back up within four to five feet of
the building elcvatitm.

Councihncmbct I<~urak asked it' thet ~; ,^fill be a restaurant with outdoor seating in the area that juts
over thc pond.

Mt'. Mcl)onald replied it is being to~>ke(l at as a combination of three different restaurants sharing
an outdoor

Councilmcmbcr K t~rak asked if ther; xvi It be any fountains as an amenity.

Mr. McDonald t'cplied there will lik.::ly be a fountain needed for water quality.

Councilmembcr [41vig stated ho is pleased to see Cobums as a potential here, and the friends and
neighbor's hc has t(~lcl about this art: happy. He expressed concern with the liquor store and the
gas station in combination with the grocery store. He noted the task force voted out a gas station
component fi'om thc matter of the imase in the downtown area. He would look to discuss the
fimction ami trafficking, and Fire an~i safety concerns.

Assistant (:ommunity Devclopmen~ Director Trudgeon explained from a land use point it was
very deliberate in ibc Town Ccnte~ zo~fing code not to allow for a gas station for the reasons
Cotmcihncmbc~- Elvig mentioned. !n looking back they did not want a free standing gas station
on at corneY wilh a~ big canopy and ~:onvenient location. They also do not want an island at the
edge of a parking l,~t with a cm'~opy and shack for people to pay. What is being proposed here is
different; it will be limited to six p,m~ps, and people can pay at the pump or go into the bigger
building. TI]crc was a lot of discussion at the Town Center Task Force and Planning
Commission in rciation to lhis. '?here was some trepidation about gas stations. This was
described mo~'e its a gas componeni, that would help the market share and have good cost and
promotion with thc operation. The thought was that a zoning amendment would be needed. A
zoning amcndmem would state cl~;arly that gas operations are allowed as long as it is an
accessory usc to a ~nain building wi Jla limits on the number of pumps, and possibly architectural
controls. Tht: l'la~ming Commissi(m indicated they would be willing to consider that. If the
Council's reaction is positive to this an amendment would be brought forward. He cannot speak
directly to lire issu(s or qualily issuus, which can be discussed by others.

Councihnembcr StYommen sttttc¢t slte had some concerns initially and then thought about it in a
di fgcrcnt way. ?art of the concept o i' Town Center was that it would offer a full range of services,
and gas is onc of ll~osc services. Wherever you go you pass at least one gas station. For a short
period she liw:d in ~t place where ev,:ry iime she needed gas she had to drive out of her way to get
gas. It would bc odd to have this '!'own Center offering a full range of services and not have a
gas statio~, and sh~ changed hel' ori!,.inat thinlcing about this. This should be okay given they will
look att tl~c architcciLire.

City Council/May 11, 2004
