Case #12: Application for Motor Vehicle Sales and Repair License; Case of SR Auto <br /> <br />Community D~,vciopment Direct(:r Frolik reviewed that on April 13, 2004, the Council <br />considered an application f'rom St~ Auto for a motor vehicle sales and repair license that had <br />bccn placed on hold by the Commt,nity Development Department in order to resolve some code <br />compliance issues. 'File issues have beun resolved with the exception of the outdoor storage area. <br />The new I1-1 lti?3~way rcxlairem~:nts; state that outside storage areas must be paved with <br />bituminous or comzrete. SR Auto and the property owners are requesting a waiver for two <br />masons: 1) thc sl~rage area will b~z I(}0% screened and the type of surface inside the enclosure <br />will not be visible ~,o thc public; 2) the property cun'ently has no hard surface improvements and <br />is considered lawful non-conlbrmir~g; the applicants state that it does not seem logical to pave a <br />storage area when lhe vehic}e display area does not have to be paved. <br /> <br />Councih~mmber Cook noted another' reason not to require the paving is that this is in the official <br />mapping area [~r lJighway 10. <br /> <br />Motion by Counci[mcmbcr Cook, ;econded by Councilmember Pearson, to approve SR Auto <br />application I'or a ~notor w:hicle license contingent upon providing a 55' x 6' enclosure for <br />outdoor storage by June 30, 200~!~ and providing the City with a surety in the amount of <br />$2,400.00 to cnsulx~ compliance witi~ the license contingency. <br /> <br />Further discussion: Councilntcmbc ~' K urak questioned how inspections will be addressed. She <br />expressed concc:rn ~hat thc fluids ar( noi always drained from the cars. Community Development <br />Director Frolik replied inspections v,~outd be allowed by Fire Inspection, as there was a fire here. <br />Thc applicant u~xlorstands his roqui~ omcnts xvith the county now, and the county has the attthority <br />to go onto thc property and inspect. Stuff is proposing a surety to ensure the fence is put up in a <br />tin]ely manner. Mayor Garnet returned to the meeting at 9:33 p.m. Councilmember Elvig <br />stressed the hood to make sure lhe lxndowner and the business owner understand the City has the <br />authority to go onto thc properly for i~ospections. Radu I<h-yshmaru, Owner of SR Auto, replied <br />the landowners arc aware of this aml he does not have any problems if the property is inspected. <br /> <br />Motion carried. Votin;~ No: None. <br /> <br />Case #13: <br /> <br />(~onsider Adopting Policy Relating to the Construction of Sound Walls along <br />County Roads <br /> <br />Assistant l'ublic Works Director Ol.xon stated during the review of the Alpine Woods <br />Subdivision, staff' was dircci, od to draft a policy relating to the construction of sound walls along <br />county roads. Aftu'r doing researcl,, staff found that Mim~esota Statute 116.07 Subdivision 2a <br />exempts roadways under county jurisdiction from the State Noise Standards unless the roadway <br />has full access cuntrol. Thc policy that has been drafted references this statute.
