6. We shall control erosion by wind or water.

We have placed a $7500.00 bond for the other grading, and
excavation permit and we do not feel, or know of any
precedent that one should be required for the reason stated.
We will agree to reasonable expense incurred by the city
in adminstering the permit afer one is issued.

I am answering your letter because of my agreement on
the property pertaining to the grading and excavating. We are
incurring additional unanticipated on going expenses do to the
current stoppage by the city of importing topsoil material.
In our interpretation of our pennit, with the allowance of
filling, being included, we thought what we were doing was allowed,
and therefore we were in compliance with all laws and ordinances.
We made an attempt on July 8 to pruchase a permit but were unable
to get one because as far as we know, none had been issued to anybody
prior to this time. Because of our additional expenses we would
appreciate the earliest possible resolution to the situation.

Yours truly,

President

NDH:jl

Dave H~rtley, City Admin.
Bill Goodrich, City Attorney
Anne Norris, Conm.
