- 6 - <br />Section 4.2 Limitations on Owner's Rights and Easements. <br />Except as otherwise provided herein, the Owner's rights and <br />easements created hereby, the right of the Association to govern <br />the use and enjoyment of the Property, and the right and title of <br />the Association to the Common Driveways, shall be subject to the <br />following: <br />a. The right of the Association, in accordance with the <br />Governing Documents to maintain, repair and replace <br />portions of each Common Driveway pursuant to Article X; <br />and <br />b. The right of the Association, in accordance with the <br />Governing Documents, to improve the Common Driveway, and <br />in furtherance thereof to borrow money and to mortgage <br />said Common Driveways; provided, however, that the <br />rights of such mortgagee in said Common Driveways shall <br />be subordinate to the Declaration and to the rights of <br />the Owners and the First Mortgagees; and <br />c. The right of the Association to suspend the voting <br />rights of any Owner or Occupant, and his or her family <br />members, or guests for any period during which any <br />assessment against the Owner's Lot remains unpaid; and <br />for an additional period of up to 30 days for each <br />violation of the provisions of the Governing Documents <br />and Rules and Regulations. <br />d. The right of the Association to dedicate or transfer all <br />or any part of the Common Driveways to any public <br />agency, authority, or utility for such purposes subject <br />to written approval by Members entitled to cast two- <br />thirds (2/3) of the votes of each class of membership <br />and a like percentage of the First Mortgagees; or the <br />right of the Declarant to effect such a dedication or <br />transfer at its sole discretion prior to the Conversion <br />Date. <br />Section 4.3 Use of the Property. In addition to any other <br />restriction which may be imposed by the Governing Documents or <br />by law; the use and conveyance of Lots shall be governed by the <br />following provisions: <br />a. The Houses shall be used by Owners and Occupants and <br />their families, guests as private residential dwellings <br />
