Mr. Johnson said they have no objection to relocating the pedestrian easement <br />to Lot 6, Block 2 and it would provide access for the property to the west of <br />the plat also. <br /> <br />Art Dunn said he does not see any need for park land on both sides of the Brook. <br /> <br />Ken Peterson stated that if land is not taken on both sides that the City <br />could ask for a scenic easement. <br /> <br />Ben Deemer said he doesn't think a scenic easement is necessary with the flood <br />plain ordinance. He agreed that Lot 6, Block 2 would be a better location for <br />the pedestrian trail, however, he thinks this will be a dead end park without <br />adequate access and no one will be able to get to it. He feels the City <br />should not have anything to do with taking park property east of Highway 47 <br />along Trott Brook because it is useless. And if the City plans to pursue what <br />they have envisoned for the Brook trail system it will be necessary to condemn <br />the property. This park would never be developed because of the flood <br />restriction - it would just be another nature area and the people that own <br />it cannot do anything with it anyway. <br /> <br />Art Dunn clarified that the floodway is restricted, but there are some things <br />'that could be done in the floodplain. <br /> <br />Gerald Zi~erman said he feels the pedestrian easement should be moved over <br />to -the westerly line, if there is to be one, but he does not see a need for <br />taking land on both sides of the Brook. <br /> <br />Paul Johnson reported on his future resubdivision plan that it would not be <br />adding any roads only showing how lots could be resubdivided. <br /> <br />Motion by Art Duma and seconded by Ron West to recommend approval of Meadowbrook <br />Estates preliminary plat provided that the drainage and grading plans meet <br />approval of the City Engineer and are in accordance with the City ordinance <br />and 'that all of the other items as pointed out in the Engineer's report <br />are conformed to and be included on a revised preliminary plat. Further, <br />that street profiles be submitted and that the City Comncil decide regarding <br />the park dedication matter as recommended by the Park Board. If the park <br />as proposed on the plat is taken, then a scenic easement on the south side <br />of the Brook in the 880 foot elevation should be granted to the City. <br />The cul de sac on 174th is to be eliminated to the west and made a temporary <br />turn around easeraent instead. The park easement, if needed, is to be moved <br />to the west end of Lot 6, Block 2 and the developer is to comply with all <br />the deficiencies of the City Code. <br /> <br />Motion carried. 3 Ayes. Deemer and Zimmerman voted Naye. <br />Ken Peterson Abstained. <br /> <br />Ben Deemer stated that he voted Naye because he felt that if the developer <br />had read the platting ordinance as he said he had there would not have been <br />so ma~y deficient items. <br /> <br />Kathleen Schneider stated that she wished that some of the items could have <br />been taken care of before coming into the Commission for preliminary plat approval. <br /> <br /> P&Z <br />February 4, 1980 Page 3 <br /> <br /> <br />
