PROPOSED CONDITIONAL USE PERMIT BARTON SAND AND GRAVEL COMPAh~Y On August , 1987, a conditional use permit was issued to Barton Sand and Gravel Company for extracting aggregates in the I-1 Industrial District. The legal description of the subject property is as follows: The north half of the northwest quarter of Section 27, Township 32, Range 25, Anoka County, Minnesota with the exception of two acres for a total of approximately 78 acres. This permit was issued pursuant to Section 170.013D of the Ramsey City Code. This conditional use permit is perpetual in its duration so long as the conditions imposed herein are complied with. The conditions of this permit are as follows: A phasing plan and restoration shall be provided and followed to minimize wind and water erosion of the site and which plan shall not allow for more than 5 acres to be exposed at any one time. The phasing and restoration plan shall be provided to and approved by the City Engineer prior to any excavation and extraction. Said plans are attached hereto and incorporated herein as Exhibit A. Restoration as used herein shall be defined as meaning grading and topsoil replacement and grass seeding such that turf is established that will prevent water and wind erosion. A buffer area shall be between 75 and 125 feet in width along the northern boundary of the property and shall include trees of the density, variety and size to be approved by the City Engineer. Such buffer area shall be located between the residential properties to the north and the extraction operation. No work shall be commenced within 660 feet of the northern boundary until the buffer area has been established such that the trees planted in the buffer area are at least 6 feet in height. 0nly State, County and Municipal State Aid streets constructed to 9 ton standard shall be used as haul roads. 4. All final slopes shall be less than 4 feet horizontal to 1 foot vertical (4:1). 5. The hours of the extraction operation shall be limited to the following: Monday through Saturday 7:00 a.m. to 7:00 p.m.. e The Applicant shall not grade and excavate more than 5 acres at any one time. However, the Applicant may be restoring one 5 acre site while commencing new operations on another 5 acre site. Applicant shall notify the City Engineer for inspection of restored areas. A performance bond in the amount of $ 10,000.00 shall be filed with the City prior to beginning any excavation or extraction. This bond shall be used to cover any costs incurred by the City in performing any screening, buffer and turf establishment shown on the restoration plan.
