PROPOSED CONDITIONAL USE PERMIT <br />BARTON SAND AND GRAVEL COMPAh~Y <br /> <br />On August , 1987, a conditional use permit was issued to Barton Sand and <br />Gravel Company for extracting aggregates in the I-1 Industrial District. <br />The legal description of the subject property is as follows: <br /> <br />The north half of the northwest quarter of Section 27, <br />Township 32, Range 25, Anoka County, Minnesota with the <br />exception of two acres for a total of approximately 78 <br />acres. <br /> <br />This permit was issued pursuant to Section 170.013D of the Ramsey City <br />Code. This conditional use permit is perpetual in its duration so long as <br />the conditions imposed herein are complied with. The conditions of this <br />permit are as follows: <br /> <br />A phasing plan and restoration shall be provided and followed to <br />minimize wind and water erosion of the site and which plan shall <br />not allow for more than 5 acres to be exposed at any one time. <br />The phasing and restoration plan shall be provided to and approved <br />by the City Engineer prior to any excavation and extraction. Said <br />plans are attached hereto and incorporated herein as Exhibit A. <br />Restoration as used herein shall be defined as meaning grading and <br />topsoil replacement and grass seeding such that turf is <br />established that will prevent water and wind erosion. <br /> <br />A buffer area shall be between 75 and 125 feet in width along the <br />northern boundary of the property and shall include trees of the <br />density, variety and size to be approved by the City Engineer. <br />Such buffer area shall be located between the residential <br />properties to the north and the extraction operation. No work <br />shall be commenced within 660 feet of the northern boundary until <br />the buffer area has been established such that the trees planted <br />in the buffer area are at least 6 feet in height. <br /> <br />0nly State, County and Municipal State Aid streets constructed to <br />9 ton standard shall be used as haul roads. <br /> <br />4. All final slopes shall be less than 4 feet horizontal to 1 foot <br /> vertical (4:1). <br /> <br />5. The hours of the extraction operation shall be limited to the <br /> following: Monday through Saturday 7:00 a.m. to 7:00 p.m.. <br /> <br />e <br /> <br />The Applicant shall not grade and excavate more than 5 acres at <br />any one time. However, the Applicant may be restoring one 5 acre <br />site while commencing new operations on another 5 acre site. <br />Applicant shall notify the City Engineer for inspection of <br />restored areas. <br /> <br />A performance bond in the amount of $ 10,000.00 shall be filed <br />with the City prior to beginning any excavation or extraction. <br />This bond shall be used to cover any costs incurred by the City in <br />performing any screening, buffer and turf establishment shown on <br />the restoration plan. <br /> <br /> <br />
