4/5 vote is required to adopt zoning ordinances.

Motion by Councilmember Cox and seconded by Councilmember DeLuca to adopt
Resolution ~87-245 establishing an airport safety zoning ordinance for
Gateway North Industrial Airport. (Please refer to resolution file for
Resolution ~87-245).

Further Discussion: Councilmember DeLuca stated that there i~ an aiport in
existence and there should be zoning in place for it; the issue of airport
zoning is separate from the issue of whether the airport will be expanded.
Councilmember Sorteberg inquired if the City is ignoring previous action
taken regarding holding an advisory election. Councilmember DeLuca replied
that a Bore appropriate time for an advisory election would be the second
quarter of 1988. Councilmember Pearson stated that the zoning being
adopted will also protect the existing airport and can be scaled down if
necessary; whether the airport is expanded or not, it is critcal for zoning
to be adopted to protect the people that are already there.

Mayor Reimann called for a roll call vote:

Councilmember Fearson - Aye
Councilmember DeLuca - Aye
Mayor Reimann - Aye
Councilmember Cox - Aye
Councilmember Sorteberg - Aye

Motion carried.

Councilmember Cox stated that now there is action in place to which the
people can respond by petitioning for a referendum on the zoning Ordinance;
by their action they may render an advisory elecnion mute and not needed.

Councilmember DeLuca stated that h~ unders
_~ ~=ndz~g of the events that took
place at the Council meeting o~_ August ~ '
~ was that Counczl was indicating
there should be an advisory election whether the City should have an
airport; the minutes reflecL that the adviscry election was to be on
whether or not ~fety zoning sh~''~ be ad~ed Co,'n~ilmember ~.~ ....
_~,qu___d as tc what the questicr, w/ii De if an advisory election is held in
-,~'c~S -- z^ning~ cr city, ~ er~hi~

Councilmember Coz replied that the question would be on zoning for the
expanded faaiiitv.

crdinance and tk~_ ~er ~r-~= ~._- circui-:=~ ~ a pet<~4~-_._~. asking for a re=_~_~_d,,m_
cn the cuest~cn cf whether or ~t th-t crdimance should b= ra~f~ed u.
naru!ey inquired if it is Count:~'~ : .... t ~e .... e tker advis~5
e!e:tic, n at a later dare cm the s~e cuesticn cr on whether the city should
be involved .... ~ owning an a~;.~-~e.~_~.

Page 9 cf i8
