Presentation <br /> <br />Community Development Director Frolik advised the Environmental Overlay regulations of City <br />Code arc thc remaining sections of Chapter 9 in need of updating as a result of the adoption of <br />the new Comprehensive Plan. She indicated these sections include Flood Plain, Rum River <br />Overlay District, Shoreland Management, Mississippi Overlay District, and Wetlands. She stated <br />thc review tonight is on the Shoreland Management sections. <br /> <br />Community Development Director Frolik stated the proposed modifications to the State <br />Shoreland Management model ordinance include: <br /> > Section 9.24.05 subd. 6 - State model provides a maximum height of 25 feet for <br /> residential structures. The City is requesting flexibility under MN Rules 6120.2800 <br /> Subd. 3. hnplementation Flexibility, to allow structures to be 35 feet in height. <br /> <br />Section 9.24.05 Subd.5. Lot Area and Width Standards <br /> o The City would like to describe the unit types in a more identifiable manner using <br /> the number of units per building: single unit, two-unit, three-unit and four-unit. <br /> o Condo~ninium ownership is a common arrangement in twinhome and townhome <br /> residential developments. Platting techniques for these developments makes it <br /> difficult to apply bulk standards when the land area of a unit includes what is <br /> within the confines of the walls. The proposed ordinance aggregates the private <br /> unit land with the common areas and dividing it by the total number of units to get <br /> square feet per unit. <br /> <br />Public Input <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Jeffrey to close the public hearing at <br />9:07 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Jeffrey, Brauer and Shepherd. <br />Voting No: None. Absent: Commissioners Johnson, Van Scoy and Watson. <br /> <br />Com~nission Input <br /> <br />Chairperson Nixt stated two major deviations were discussed, and asked if there are other <br />changes required from the Comprehensive Plan amendment to comply. <br /> <br />Community Development Director Frolik indicated the consultant relayed that the two most <br />significant changes are the two mentioned. <br /> <br />Commissioner Brauer asked if 35 feet is the current residential height limit and Community <br />Development Director Frolik stated it is. <br /> <br />Planning Commission/May 6, 2004 <br /> Page 16 of 22 <br /> <br /> <br />
