He stated Staff said they could draft <br />language that would reinforce this if it was acceptable to the Planning Commission. <br /> <br />Commissioner Brauer asked if this is a deal killer with Coburn's and Mr. Voss stated he does not <br />know, but it could be. <br /> <br />Chairperson Nixt asked what the recommendation was from the Task Force. <br /> <br />Assistant Community Development Director Trudgeon stated they did not supply a formal <br />recommendation, but the feeling was this was a good, improved plan, and they were generally in <br />favor of it. <br /> <br />Chairperson Nixt asked if Staff felt they could draft language to protect the City from other gas <br />stations in this area. <br /> <br />Assistant Community Development Director Trudgeon stated he believes they could, and it is the <br />only way he would be comfortable with it being approved. <br /> <br />Chairperson Nixt clarified if the Planning Commission were to say this is contingent on an <br />ordinance being drafted that would prohibit additional gas stations, the Planning Commission <br />would see the ordinance back before them. <br /> <br />Assistant Community Development Director Trudgeon indicated they would, along with several <br />amendments to the ordinance to address some of the design standards. <br /> <br />Chairperson Nixt expressed that as presented, with the gas amenity, he could be convinced this <br />was a good project. Ite stated they need to deal with the setback issues. <br /> <br />Assistant Community Development Director Trudgeon indicated he does not know if the <br />Planning Commission wants to deal with them as variances each time they come up, or if it <br />would be better to tweak the language of the ordinance to address the issue. <br /> <br />Chairperson Nixt stated he thinks Staff could draft a variance to cite all the things the applicant <br />has donc to increase the value of the development, and he would rather not change the language <br />off the ordinance for this purpose. <br /> <br />Commissioner Brauer stated he likes this layout better than the last one. He thinks the waterfront <br />is a nice piece, whereas before it was just a little pond. <br /> <br />Commissioner Brauer noted the other piece they were having trouble with was the northwest <br />COl'rlcr. <br /> <br />Mr. Voss stated in that area they pretty much started from scratch.
