Absent: Chairperson Levine. <br /> 5.05: Public Hearing: Consider Amendments to Wetland Protection Overlay District to <br /> Establish Wetland and Storm Water Pond Setbacks and Establish a Minimum Lot <br /> Depth for Newly Created Residential Lots (Project No.16-39) <br /> Public Hearin <br /> Vice Chairperson Bauer called the public hearing to order at 8:56 p.m. <br /> Presentation <br /> City Planner Anderson presented the staff report stating the purpose of this Ordinance is twofold. <br /> First, it is to bring the City into compliance with the Lower Rum River Watershed Management <br /> Organization's (LRRWMO) 3rd Generation Plan by implementing a wetland setback. The <br /> second purpose of the Ordinance is to address feedback from residents over the past couple years <br /> regarding remaining buildable area on some parcels after wetlands and floodway have been <br /> factored out. The Ordinance establishes a minimum lot depth for all newly created residential <br /> lots in an attempt to provide a reasonable rear yard to accommodate common homeowner <br /> improvements such as decks and sheds. Staff explained the Environmental Policy Board <br /> reviewed the draft Ordinance at its February 22, 2016 meeting and recommended City Council <br /> adopt Ordinance #16-03. <br /> Citizen Input <br /> Commissioner VanScoy asked if the City Engineer had any issues with the proposed Ordinance. <br /> Civil Engineer Linton explained he has been fully involved in the Ordinance process and <br /> supported the proposed setbacks. He believed the new Ordinance would greatly assist property <br /> owners in the future. <br /> Motion by Commissioner Maul, seconded by Commissioner VanScoy, to close the public <br /> hearing. <br /> Motion Carried. Voting Yes: Vice Chairperson Bauer, Commissioners Maul, VanScoy, <br /> Andrusko, Brauer, and Nosan. Voting No: None.
