Assistant Public Works Director Olson explained staff wanted to discuss the design elements. <br />There has been a lot of work to define landscaping and the architectural scheme, and the vision <br />as to what is included in this parks proposal. They have made a lot of progress, but there are still <br />some issues that need to be more clearly defined. Town Center LLC is proposing to supply 4.2 <br />million dollars worth of improvements, to dedicate the land, and to provide $1,500 per house or <br />lot sold to be made available for the creation of Downtown Commons and Civic Square Park. <br /> <br />Mayor Pro Tern Zimmerman questioned if the $1,500 per house or lot is above the park <br />dedication fee. <br /> <br />Assistant Public Works Director Olson responded in the affirmative. <br /> <br />Mayor Pro Tern Zinnnerman asked if Town Center LLC will expect these funds to be spent <br />around their parks. <br /> <br />Assistant ?ublic Works Director Olson explained the $1,500 is per building permit that is issued. <br />The multi-family units will only receive one building permit. The funds will be an escrow that <br />will be held by LLC that will be used specifically for Civic Square and Downtown Commons <br />improvements. <br /> <br />Cotmcihnembcr Cook asked if it has been determined who will own the two parks and who will <br />have first call for their use. <br /> <br />Assistant Public Works Director Olson explained the parks will be dedicated as City parks. If the <br />association wants to use the escrow as a bargaining chip for exclusive rights or rights of refusal <br />for scheduled activities it would have to go before the City Council. <br /> <br />Mr. Jacobsen stated the goal is that they are all working toward the same thing. Use of the park <br />would be more of a scheduling issue, and it is not in anyone's best interest for the RTC to <br />schedule a specific event on July 4th when the City has big plans. The notion is that Civic Square <br />will be the central gathering place and also the information place. The person or group of people <br />at thc RTC will know all the events and work with the City to schedule specific things. <br /> <br />Councihnembcr Elvig asked how long this agreement would be for. <br /> <br />Assistant Public Works Director Olson replied it would be as long as the developmeflt builds out. <br />As Councihnember Kurak had indicated earlier, City Hall will be an occupant within this so they <br />will have some responsibility to be within the association, and he thi~s that relationship will be <br />ongoing. As far as this agreement is concerned, this will be in effect until such point in time that <br />Town Center is built out. <br /> <br />Councihncmbcr Cool( commented the City would then own the property, but it would be in their <br />best interest to have a joint agreement for use of the property with the association. He would <br />assume Town Center LLC would be involved with the association until the time of the build out <br />so things mn smoothly. He stated this is a very good plan.
