Once Staff and the Cow~issions have reviewed the <br />request, their o~n~ents and recorrendations are forwarded to the <br />City Council for their consideration. In addition to these <br />con~ents, the Co~n~cil will consider the following ratters: <br /> <br />A. Will the request benefit the City as a whole? <br /> <br />B. Will the request encourage othe~ private develoL~ent <br /> of the a~ea? <br /> <br />C. Does the Go~cil feel that this request will not occur <br /> without wunicipal financial assistance? <br /> <br />Section 5. If the Council approves a request for financial <br />assistance, all approvals will be contingent upon the developer <br />entering into a development agreement with the City. This <br />agreewent shall be drafted by the City's bond counsel and will <br />specify, but is not liwited to, the following= <br /> <br />A. ~he City's financial co~=itwent; <br /> <br />B. Cor~litions of the C~ty's participation; <br /> <br />D. Co~litions of the developer's p~rticipmtion; <br /> <br />E. ~ents of default; <br /> <br />F. Ten~s for transfer or assignment of agre~ent; <br /> <br />G. ~ication; and <br /> <br /> <br />
