(Rev. 1083) <br /> <br />The City Count11 shall not grant Site Plan approval <br />until they have received a report and recommendation <br />from the Planning Commission and the Ctty Staff. The <br />Ctty Council shall review all recoa~endattons and <br />approve or deny the application for Site Plan <br />approval wtthtn s.txty (60) days of the tnttlal Ctty <br />Counct1 14eettng at whtch the case was heard. <br /> <br />Upon receiving the report and reconeendatlon <br />of the Planntng Conetsston and th.e City Staff, <br />the Ctty .Counct l shall place the report and <br />rec~endatlon on the agenda for the next <br />regular meettng. Such reports and <br />recommendations shall be entered tn and made <br />· part of the permanent wrttten record of the <br /> City Counct1 Meeting. <br /> <br />Upon receiving the report and recommendation" <br />of the Planning Commission and the City Staff, <br />the Ctty Counctl shall have the optton to set <br />and hold a publlc heartng tf deemed necessary <br />and shall make a recorded ftndtng of fact and <br />may tmpose any condition tt considers <br />necessary to protect the publlc health, <br />safety, and welfare. <br /> <br />If, upon reviewing said reports and <br />recmmnendattons of the Planntng Con~nts~ton and <br />City Staff, the City Council finds that <br />specific inconsistencies exist tn the review <br />process and thus the final recon~endatton of <br />the City Council will differ from that of the <br />Planning Commission, the City Counct1 may, <br />before taktng final action, refer the matter <br />back to the Planntng Commission for further <br />consideration. The City Council shall provtde <br />the Planntng Con~tsston with a wrttten <br />statement detailing the spectftc reason for <br />referral. This procedure shall be followed <br />only one time on a singular action. <br /> <br />(tv) <br /> <br />I~henever an application for Site Plan Revtew <br />has been considered and dented by the Ctty <br />Council, a stmtlar application affecting <br />substantially the same property shall not be <br />considered agatn by the Planning Conetsslon or <br />Clty Counctl for at least stx ($) months from <br />the date of 1ts denial; and a subsequent <br />application affecting substantially the same <br /> <br /> <br />
