(Rev. 1083) The City Count11 shall not grant Site Plan approval until they have received a report and recommendation from the Planning Commission and the Ctty Staff. The Ctty Council shall review all recoa~endattons and approve or deny the application for Site Plan approval wtthtn s.txty (60) days of the tnttlal Ctty Counct1 14eettng at whtch the case was heard. Upon receiving the report and reconeendatlon of the Planntng Conetsston and th.e City Staff, the Ctty .Counct l shall place the report and rec~endatlon on the agenda for the next regular meettng. Such reports and recommendations shall be entered tn and made · part of the permanent wrttten record of the City Counct1 Meeting. Upon receiving the report and recommendation" of the Planning Commission and the City Staff, the Ctty Counctl shall have the optton to set and hold a publlc heartng tf deemed necessary and shall make a recorded ftndtng of fact and may tmpose any condition tt considers necessary to protect the publlc health, safety, and welfare. If, upon reviewing said reports and recmmnendattons of the Planntng Con~nts~ton and City Staff, the City Council finds that specific inconsistencies exist tn the review process and thus the final recon~endatton of the City Council will differ from that of the Planning Commission, the City Counct1 may, before taktng final action, refer the matter back to the Planntng Commission for further consideration. The City Council shall provtde the Planntng Con~tsston with a wrttten statement detailing the spectftc reason for referral. This procedure shall be followed only one time on a singular action. (tv) I~henever an application for Site Plan Revtew has been considered and dented by the Ctty Council, a stmtlar application affecting substantially the same property shall not be considered agatn by the Planning Conetsslon or Clty Counctl for at least stx ($) months from the date of 1ts denial; and a subsequent application affecting substantially the same
