Further Discussion: Mayor Gamec stressed the need to review the sign issue.

Case #10: Request for luterim Use Permit to Allow for Outdoor Storage as a Principal
Use in the E-1 Employment District; Case of Nohad Loabnch
Community Developlnent Director Frolik explained Nohad Loabnch of Metro Environmental
Site Services Inc. has submitted an application for an Interim Use Permit to allow for outdoor
storage of construction trailers and boxes as a principal use on the property located off of 156th
Avenue situated within West Ramsey Industrial Park. Mr. Loabnch's property is approximately
two acres in size and is zoned E-1 Employment. The applicant owns Metro Environmental Site
Services Inc., which requires storage of three construction boxes and three trailers. City Code
states outside storage of equipment is permitted with the issuance of a conditional use permit.
Thc applicant decided to apply for an interim use permit due to the fact that he does not plan on
utilizing the subject property for outside storage as a principal use for the life of the property.

Community Development Director Frolik indicated the Planning Commission held a public
hearing and reviewed the request at their June 3, 2004 meeting. Kevin and Jennifer Ly~mes'
stated concern and opposition to the interim use permit during the public hearing. Mr. and Mrs.
Lynnes' stated that they believe the applicant to be storing hazardous materials in the
construction boxes and to be parking business vehicles on the public street in close proximity to
their business. The applicant assured the Planning Commission and staff that no hazardous
materials are being stored on the subject property and the company vehicles are related to picking
up and dropping off the equipment. The applicant is requesting a four year interim use permit.
The Planning Commission stated some concern related to the requested four year term. The
Planning Commission recommended the City Council approve the interim use permit for a term
of two ycars. The Planning Commission also stated their concern about the possibility of
hazardous materials being stored on the property, therefore, staff included a condition in the
interim use permit that clearly states no hazardous or harmful materials are to be stored within
the construction trailers or boxes. Staff did try to set up a meeting between the Lynnes' and Mr.
Loabnch, but the Lynnes' did not return staff's calls.

Mayor Gamec questioned the two year period for the interim permit. He stated the City had a
hard time cleaning up this area and he would question if it is proper to have storage like this.

Community Development Director Frolik replied there is screening from the trees, and the
storage is quite a distance, with only six pieces of equipment. The code does make provisions for
temporary or long term uses like this.

Councihnember Pearson asked if the zoning has changed on this land. He explained one
gentleman was concerned that he was required to have brick fronting, curb and gutter, and nice
sod.

Comlnunity Development Director Frolik replied the zoning is basically the same. The
architectural standards over the years have increased. If this applicant were to develop this

City Council/June 22, 2004
