Council Business <br />Motion by Councilmember Riley, seconded by Councilmember LeTourneau, to Adopt <br />Resolution #16-08-143 Vacating a Portion of Drainage and Utility Easement on the Property <br />Generally Known as Outlot A, A.E.C. Energy Park Fourth Addition. <br />Motion carried. Voting Yes: Mayor Strommen, Councilmembers Riley, LeTourneau, Johns, <br />Kuzma, and Shryock. Voting No: None. Absent: Councilmember Williams. <br />7. COUNCIL BUSINESS <br />7.01: Consider Approval of Request for Special Events Permit; Case of The Penalty Box <br />Bar and Grill, 14077 St. Francis Boulevard NW <br />City Clerk Thieling reviewed the staff report and recommendation to approve the request for the <br />Special Events Permit for The Penalty Box, which also includes allowing the band to play until <br />midnight with the criteria specified in the case. She noted that the applicant has held similar <br />events in previous years. She also noted that the Fire Department had not yet received what it <br />needs to approve the tent permit and that staff has extended the deadline for receipt of such <br />paperwork to September 1. Council is asked to make the approval contingent upon that as well. <br />Mayor Strommen stated that she is aware that the City has allowed this in the past and was not <br />aware of complaints. She asked staff for additional information. <br />City Clerk Thieling stated that she did receive one complaint in the past regarding trash in the <br />parking lot the following morning. <br />Councilmember Kuzma stated that he would like to see a condition specifying that the trash is <br />picked up by a certain time. <br />City Clerk Thieling stated that a garbage plan was included in the application, which consisted of <br />20 additional trash receptacles, noting that the applicant is responsible for cleaning the area the <br />next morning. <br />Councilmember Kuzma stated that he would like to see a condition requiring trash to be picked <br />up by noon the next day. <br />Police Chief Katers stated that this event has been offered a number of years and there have been <br />a few complaints that are in the file; however, there have not been a significant number of them. <br />He felt that the conditions included by Clerk Thieling are intended to address a those complaints. <br />He stated that there are sound measurement tools and that has been done in the past and noted <br />that the volume is required to be turned down after 11:00 p.m. <br />Motion by Councilmember Kuzma, seconded by Councilmember Johns, to approve the Special <br />Events Permit for The Penalty Box Bar and Grill, 14077 St. Francis Boulevard NW, contingent <br />upon the following: <br />City Council / August 23, 2016 <br />Page 6 of 10 <br />
