Council Business Motion by Councilmember Riley, seconded by Councilmember LeTourneau, to Adopt Resolution #16-08-143 Vacating a Portion of Drainage and Utility Easement on the Property Generally Known as Outlot A, A.E.C. Energy Park Fourth Addition. Motion carried. Voting Yes: Mayor Strommen, Councilmembers Riley, LeTourneau, Johns, Kuzma, and Shryock. Voting No: None. Absent: Councilmember Williams. 7. COUNCIL BUSINESS 7.01: Consider Approval of Request for Special Events Permit; Case of The Penalty Box Bar and Grill, 14077 St. Francis Boulevard NW City Clerk Thieling reviewed the staff report and recommendation to approve the request for the Special Events Permit for The Penalty Box, which also includes allowing the band to play until midnight with the criteria specified in the case. She noted that the applicant has held similar events in previous years. She also noted that the Fire Department had not yet received what it needs to approve the tent permit and that staff has extended the deadline for receipt of such paperwork to September 1. Council is asked to make the approval contingent upon that as well. Mayor Strommen stated that she is aware that the City has allowed this in the past and was not aware of complaints. She asked staff for additional information. City Clerk Thieling stated that she did receive one complaint in the past regarding trash in the parking lot the following morning. Councilmember Kuzma stated that he would like to see a condition specifying that the trash is picked up by a certain time. City Clerk Thieling stated that a garbage plan was included in the application, which consisted of 20 additional trash receptacles, noting that the applicant is responsible for cleaning the area the next morning. Councilmember Kuzma stated that he would like to see a condition requiring trash to be picked up by noon the next day. Police Chief Katers stated that this event has been offered a number of years and there have been a few complaints that are in the file; however, there have not been a significant number of them. He felt that the conditions included by Clerk Thieling are intended to address a those complaints. He stated that there are sound measurement tools and that has been done in the past and noted that the volume is required to be turned down after 11:00 p.m. Motion by Councilmember Kuzma, seconded by Councilmember Johns, to approve the Special Events Permit for The Penalty Box Bar and Grill, 14077 St. Francis Boulevard NW, contingent upon the following: City Council / August 23, 2016 Page 6 of 10
