Cas~ ~}10: <br /> <br />Request For A Conditional Use Permit To Grade And Excaygte <br /> To_Creat~e A Man-Made Lake In Northfork P.U.D.~ Case Of L&G <br /> Rehbein. Inc.: <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to adopt <br />Findings of Fact 0163 relating to L&G Rehbein's request for a conditional <br />use permit to excavate to create a lake in Northfork P.U.D. (Please refer <br />to findings of fact file for Findings of Fact 0163). <br /> <br />Further Discussion: Mayor Reimann inquired as to responsibility for lake <br />upkeep once it is in operation. Mr. Dennis Peck stated that there are no <br />specific regulations but North Fork Development intends to abide by what <br />natural environment laws require. Mayor Reimann stated that there should <br />be controls regulating the amount and type of fertilization done in the <br />area. Mr. Peck stated that he is willing to work with the City Attorney to <br />develop reasonable controls. Mayor Reimann inquired as to responsibility <br />for damage to the road while developing the lakeo Mr. Goodrich replied <br />that the road and other issues have been addressed and documented. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />approve L&G Rehbein's request for a conditional use permit to excavate to <br />create a lake in Northfork P.U.D. contingent upon the execution of a <br />conditional use permit agreement with the City. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />DeLuca and Pearson. Voting No: None. <br /> <br />Case #11: Reques% For Site Plan Review; Case Of Mr. Robert Muller: <br /> <br />Mr. Bob Muller was present requesting site plan review of his proposed <br />shopping center to be constructed on the southwest corner of 167th Avenue <br />h~ and Rwy. #47. <br /> <br />Ms. Norris stated that a public hearing has been scheduled for May 12, 1987 <br />to consider establishing a development and tax increment financing district <br />to accommodate Mr. Muller's proposed development. <br /> <br />City Enginner Raatikka stated that City participation is estimated at <br />$131,000. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember DeLuca to approve <br />of the site plan as submitted, contingent upon Mr. Robert Muller entering <br />into a development agreement with the City. <br /> <br />Further Discussion: Ms, Norris noted that the development is contingent <br />on whether or not Mr. Muller gets the tax increment financing. <br /> <br />Motion carried.
