Voting No: None. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Pearson to <br />approve Mr. Richard Duggan's request for a conditional use permit to <br />manufacture steel horseshoes in the B-1 Business District contingent upon <br />Mr. Duggan entering into a conditional use permit agreement with the City, <br />amended as follows: <br /> <br />Add Item J5 to read as follows: 'That the hours ~f operation shall be <br />7:00 a.m. to 7:00 p.m. Monday through Saturday.' <br /> <br />Add Item #6 to read as follows: 'That the drop forge ha...,~r will not <br />emit noise levels which will exceed that specified in the City Code.' <br /> <br />Motion carried. Voting No: None. <br /> <br />Council recessed at 9:00 p.m. <br /> <br />Mayor Reimann called the meeting back to order at 9:13 p.m. <br /> <br />Case ~5-. Rsqu_ est For Sketch Plan P~view: Case Of Mr. Jake Barthold: <br /> <br />Mr. Rartley stated that Mr. Barthold has revised his subdivision <br />configuration previously reviewed by Council. Staff is recommending that <br />normal procedure be followed and that Mr. Barthold proceed with a minor <br />subdivision process with Planning and Zoning reviewing and providing a <br />recc~mmndation regarding the revised subdivision configuration and City <br />Council conducting the final review of the subdivision. <br /> <br />Councilm~mber DeLuca recalled Planning and Zoning's concerns expressed at <br />the last joint meeting regarding City Council circumventing standard <br />operating procedures. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cox, for <br />further discussion, to refer Mr. Barthold's revised subdivision request to <br />Planning and Zoning for their review and rec(mm~ndations. <br /> <br />Further Discussion: Mr. Barthold stated that he has been working on this <br />subdivision for 2-3 months and was informed by City Staff that it was not <br />necessary to submit the revised sketch plan to Planning and Zoning. <br />Councilm~ber Cox stated that the City is recommending minor platting in <br />order to avoid cumbersome legal descriptions associated with metes and <br />hounds subdivisions. Councilm~mber Cox also noted that metes and bounds <br />must be granted for hardship reasons and the City Attorney's ruling in <br />City Council/March 24, 1987 <br /> <br />Page 12 of 22 <br /> <br /> <br />
