Chairperson Nixt noted that given the land use, the applicant could be asking for more, in the <br />way of a conditional use permit, rather than an interim use permit. <br />Associate Planner Wald agreed that they could. <br />Commissioner Johnson asked if it is conceivable that when construction starts on the warehouse <br />they will move some of this equipment, and if they anticipate needing an extension after the four <br />years. <br />Mr. Loabnch indicated when the warehouse is done they will move all of it. He does not think <br />they will need longer than the four years, but that amount of time would be helpful. <br />Commissioner Van Scoy asked if any screening was required. <br />Associate Planner Wald indicated it is not adjacent to residential, so no screening is required. <br />Commissioner Johnson stated he thinks he can sense how this is going. He indicated they are <br />talking about a permitted use, and while they can put conditions on it, they cannot arbitrarily <br />deny the request. He stated Mr. Lynnes expressed concerns because he developed his property <br />and senses a deterioration of this and other properties. He is wondering if there are any <br />reasonable conditions Mr. Lynnes would recommend that would help alleviate his concerns, and <br />also asked what concerns Mr. Lynnes has concerning the other properties around him. <br />He stated for conditions, he would want them to have to put asphalt and curb and trees. <br />Jennifer Lynnes, 9550 156th Avenue indicated when they are talking about junk, she has an <br />example. She stated all winter from their front window there was a car you could see that had <br />been in an awful crash just sitting there. He indicated the owner removed it about two months <br />ago, but things like that are not conducive to a business. <br />Motion by Chairperson Nixt, seconded by Commissioner Brauer to close the public hearing at <br />7:55 p.m. <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Jeffrey, Shepherd, Van <br />Scoy and Watson. Voting No: None. Absent: Commissioner Brauer. <br />Commission Input <br />Chairperson Nixt asked if they were relaxing the requirements because this is an interim use <br />permit, versus what the requirements would be if it was a conditional use permit. <br />Associate Planner Wald stated they would not require blacktop and curbing because it is an <br />interim use. <br />Planning Commission/June 3, 2004 <br />Page 6 of 18 <br />
