N FIR~ ~ODE <br /> <br /> ~ach member city agrees to take actions necessary to establish a code of fire <br />inspection regulations that vii1 be · uniform code between sll member cities to <br />·greement. <br /> <br />~R?I CLIt ~ <br /> <br />FIRRFIGRTERS RELIEF AND FENSIOR FUFD <br /> <br /> Current members of the Anoka Volunteer Fire Department, Inc., and current members of <br />the Anoka Volunteer Fire Department Relief Association, Inc., will become members of the <br />Anoka-Champlin-Ramsey Fire Department and the Anoka-Champlin-Ramsey Fire Department <br />Relief Association upon the effective date of this joint powers agreement. <br /> <br /> Firefighters joining the fire department after the effective date of this joint <br />powers agreement, upon acceptance as permanent members of the Fire Department will, upon <br />written application, also become members of the Fire Department Relief Association. <br />Members joining the Fire Department Relief Association after the effective date of this <br />joint powers agreement will receive the same pension and relief benefits as available to <br />those individuals who were members of the Anoka Volunteer Fire Department Relief <br />Association prior to the effective date of this joint powers agreement. Changes to <br />relief and pension benefits after the effective date of this joint-powers agreement will <br />apply equally to the original members and to the new members based upon length of <br />service as defined in the Constitution and By-Laws of the Relief Association. <br /> <br /> As relief and pension benefits change, each member city agrees to guarantee the <br />payment of pension benefits at the level established, providing that any benefit <br />increases meet the requirement of "fully funded" as defined by appropriate Minnesota <br />State Statues as substantiated by an actuarial survey performed by a professional <br />accounting firm. <br /> <br />IR?ICI~ II <br /> <br />L/ABILITY - GOVERNMENTAL FUNCTIONS - PR~V'E CLAUSES <br /> <br /> In all of the joint agreements defined in this contract, the Cities of Anoka, <br />Champlin and Ramsey shall be deemed to be exercising their governmental functions so <br />that each shall not be liable to the other for any negligence of its officers, <br />employees, firefighters or agents. <br /> <br /> Specifically, without limiting the effect of the.foregoing language in the preceding <br />paragraph, either the City of Anoka, the City of Champlin or the City of Ramsey, their <br />officers, employees and firefighters shall not be liable for any of the following acts <br />or omissions: <br /> <br />Failure to answer a fire call or failure to answer a fire call promptly. <br /> <br /> For any trespass or damage to persons or property whether necessary or <br />unnecessary in connection with going to, returning from any fire call, or in serving at <br />any fire pursuant to call. <br /> <br /> <br />
