I <br />I <br />I <br />i <br />i <br />I <br />I <br /> <br />I Commissioner Deemer noted that the City is only required to <br /> supply a hearing notice to those residences within 350' of <br /> the subject area; he also noted that residents can request <br /> public hearing notices on any issue they are particularly <br /> interested in even though they do not live within that 350'. <br /> <br />The Commission reviewed the finding of fact that have been <br />prepared to this point. <br /> <br />Commissioner Deemer recomznended the following as a finding of <br />fact: <br /> <br />#8 <br /> <br />That at the regular Planning and Zoning Commission <br />Meeting of July 3, 1984, all persons wishing to <br />make a statement were invited to do so during <br />Citizen Input. <br /> <br />Chairman Peterson stated that he will entertain a motion for <br />City Staff to prepare further findings of fact based on <br />results of the June 25, 1984 public hearing and other information <br />gathered. <br /> <br />Mr. LeFevere - Stated that Staff needs more direction than <br />just to prepare findings of fact, particularly if the decision <br />of Planning and Zoning is to reconvnend denial of application -- <br />it would be good for Staff to know what those reasons are. In <br />terms of granting the permit -- know disputes of fact between <br />representatives of applicant and members of public. There are <br />many issues involved here and unless Planning and Zoning decides <br />to resolve all of those issues against Waste Management, I <br />believe it would be inappropriate for City Staff and Attorney <br />to be preparing a shotgun findings. <br /> <br />Chairman Peterson stated that the Commission can accept, reject <br />or mmend the proposal they have before them and he will now <br />entertain general discussion of which way this Cormnission wants <br />to go keeping in mind that the Commission is only recommending <br />and that if any conditions of the permit agreement are amended, <br />the applicant has the right to not enter into that agreement. <br /> <br />The Commission proceeded to review the Standards for Consideration <br />at this time. <br /> <br />a) The nature of the land upon which the use is to be located. <br /> <br />Chairman Peterson stated that Staff would address this from <br />a topography, soils, zoning and access point of view. <br /> <br />Commissioner Hendriksen referred to Commissioner Deemer's <br />recommended finding of fact #8 and inquired as to the status <br />of that recommendation. <br /> <br />Chairman Peterson replied that when the findings of fact are <br />ready for adoption as a package, the Commission can delete, <br />add or amend to them.
