i I I I I I i I i I I CASE ~5: The following items are included as enclosure (D2-c) for your consideration in this matter: a) City Council meeting minutes dated September ZZ, 1981 b) Findings of fact dated September ZZ, 1981 c) Resolution #81-141 d) Deputy Clerk's letter dated November ZS, 1981 e) Area location map f) Building Official's letter to Mr. Donald Huff Council Action: The following proposed motion is hereby submitted for your consideration: Motion by and seconded by request to subdivide his property located at 0811 parcels, contingent upon the following: to approve Mr. Donald Huffs - 154th Lane NW into two 1) That either parcel have a minimum street frontage of 160 feet. Z) That either parcel be a minimum of one acre in size. 3) That certificates of survey be provided for both of the newly created parcels. Motion carried. Voting yes . Voting no Note: This approval should probably be made by resolution. REQUEST FOR VARIANCES FROM VARIOUS STATE AND crrY CODES; CASE OF MR. GERAI-]~ SMOTHERS, MINNESOTA SAWDUST AND SHAVING COMPANY, INC.: Mr. Gerald Smothers, along with his contractor, appeared before you under citizen input at your regular Council meeting of May Z4, 1984 requesting a variance to the requirement of the State Building Code for sprinkler systems as well as a variance to our local code which requires colored metal on metal buildings. We were under the impression that you granted those variances in the same manner which they have been granted in the past and subsequently prepared an agreement and the permit upon Mr. Smother's signing the agreement. However, in reviewing the minutes we find that you failed to take action, so it will be necessary for you to take action at this time. We would advise you that Mr. Smothers is not happy with the agreement inasmuch as a sprinkler will be required at some time in the future. Enclosure (DZ-d) contains a copy of the proposed agreement for your consideration in this matter. Council Action: The following proposed motion is hereby submitted for your consideration: Motion by and seconded by to enter into a development agreement with Mr. Gerald Smothers of Minnesota Sawdust and Shaving Company, Inc., granting him a temporary variance to the requirement of the State Building Code for sprinkler systems and a variance to the requirement of the local code which requires colored metal on the roof of metal buildings.
