Voting Yes: Chairman Peterson, Commissioners LaDue, Deemer,
Hendriksen, Johnson and Zim~erman. Voting No: None. Absent: Commissioner
K~nnen.

Motion by Co~uissioner Deemer and seconded by Chairman Peterson to recommend
disapproval of Mr. Tom Holker's request to subdivide by metes and bounds two
lots from a 13+ acre parcel.

Motion carried. Voting Yes: Chairman Peterson, Commissioners LaDue, Deemer,
Hendriksen, Johnson and Zimmerman. Voting No: None. Absent: Commissioner
Kannen.

Oommission consensus is that Mr. Holker can skip the sketch plan and proceed
to the preliminary plat stage.

Mr. Berg pointed out that Mr. Holker's request for density variance will be
on the Council agenda for May 24, 1984 and Mr. Holker can request approval
to a metes and bounds subdivision at that time frc~ the Council.

Case ~9: Minnesota Utility Landfill:

Commissioner Deemer referred to Council minutes dated April 24, 1984, Case $7,
page 12 of 20, Landfill and Council's motion that the Minnesota Utility Contracting
Clean Fill Demolition Landfill license be renewed until November 1, 1984 at
which time the site must be complete and no other permits issued.

Commissioner Deemer stated that there are violations occuring at this site
and it has been impossible to get the County to inspect the site when those
violations are happening. ~nere are all kinds of things buried at that site
that are not clean fill.

Commissioner Deemer stated that Council should amend their motion to include
that regular inspections be performed at the site until it's closing in
November.

Mr. Schnelle stated that the City has called the County numerous times regarding
violations at this site and the County maintains that they are inspecting
regularly.

Commissioner Deemer stated that debris dumped there in the last two weeks
would not even be allowed at the regular landfill and it is just being covered
up; Council should recommend that the license renewal be refused.

Motion by Commissioner Deemer that Council recommend revocation of the
license application for the Minnesota Utility Landfill.

Further Discussion: Mr. Schnelle stated that hearings will be conducted at
the County Courthouse regarding license renewal applications and Commissioner
Deemer should file a complaint at those hearings.

Motion failed for lack of a second.

P & Z/May 1, 1984
