I <br />I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />-lO- <br /> <br />investigations, monitoring, sampling, and otherwise obtaining <br />necessary information pertaining to the construction, operation, <br />and environmental effect of the disposal facility, control <br />equipment and control materials. <br /> <br />The permittee shall not assign or transfer this permit without <br />first obtaining the written approval of the MPCA. An unapproved <br />assignment or transfer shall render this permit null and void. <br /> <br />This permit may be modified or revoked in whole or in part during <br />its term for causes including, but not limited to: <br /> <br />1. Violation of any terms or conditions of this permit. <br /> <br />2. Obtaining this permit by misrepresentation or failure <br /> to disclose fully all relevant facts. <br /> <br />F. The provisions of this permit are severable, and if any provisions <br /> of this permit, or the application of any provision of this permit <br /> to any circumstance, is held invalid, the application of such <br /> provision to other circumstances, and the remainder of this permit <br /> shall not be affected thereby. <br /> <br />G. The perm~ttee may request an extension of the dates set forth in <br /> this permit including the submittal and monitoring dates and the <br /> end date of this permit. The request shall include justification <br /> for noncompliance with the date. Based on the justification, the <br /> Director may grant an extension. <br /> <br />H. This permit shall not release the permittee from any liability, <br /> penalty, or duty imposed by Minnesota or federal statutes, or <br /> regulations, or local ordinances including, but not limited to, <br /> those promulgated pursuant to Minnesota Statutes Chapters 116, <br /> 400, and 473. This permit shall be permissive only and shall <br /> not be construed as estopping or limiting any claims against <br /> permittee, its agents, contractors, or assigns, nor as estopping <br /> or limiting any legal claims of the state against the permittee, <br /> its agents, contractors, or assigns for damages to state property, <br /> or for any violation of the terms of this permit. <br /> <br /> I. This permit authorizes the permittee to perform the activities <br /> described herein under the conditions set forth. In issuing <br /> this permit, the state/MPCA assumes no responsibility for <br /> any damage to persons, property or the environment caused by <br /> the activities of the permittee tn the conduct of its actions, <br /> including those activities authorized, directed or undertaken <br /> pursuant to this permit. To the extent the state/MPCA may <br /> have any liability for the activities of its employees, that <br /> · '.liability is explicitly limited to that provided in the <br /> lofts Claims Act, Minn. Stat. § 2.736 (1982). <br /> <br /> <br />
