10) That the proposed PUD does vary from the lot size, lot width and front yard setback <br />standards of the UR zone in which the PUD is to be located. The lot widths, lot sizes <br />and setbacks in the proposed PUD will be less than the standard requirements of the <br />UR zoning district in which the proposed PUD is located. That these differences from <br />the City's UR zoning district are justified by the design of the development in that <br />approximately Z0% of the gross area of the PUD has been or will be in the form of open <br />space dedicated to public use. These public use areas are (1) the park area in Flintwood <br />Hills I previously dedicated to the public for use by the proposed Flintwood Hills Second <br />Addition; (Z) the ponding area of 1.8 acres for the proposed PUD's drainage and (3) the <br />conveyance to the City of approximately 1.5 acres of property adjacent to the PUD and <br />adjacent to the old Ramsey Township Town Hall. A typical Ramsey urban plat would <br />be required to dedicate only 109{ of its gross area for similar uses. <br /> <br />11) That the plan will not create an excessive burden on parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the planned development <br />as there is adequate park area for use by the residents in the Flintwood Hills I park <br />adjacent to the proposed PUD; the proposed PUD contains within its own boundaries <br />streets necessary to serve its future residents and the applicant will be required at its <br />own cost to provide appropriate municipal facilities to serve the new residential utilities. <br /> <br />1Z) That the PUD will not have an undue and adverse impact on the reasonable enjoyment <br />of neighboring property as it is a predominantly residential development and the adjacent <br />properties surrounding the PUD are either existing residential uses or zoned for residential <br />use; the access to the PUD is adequate to serve the additional residents, as well as existing <br />residents. That the housing units to be constructed in the PUD will be of the type, <br />construction, size and architecture as to be comparable to other residential structures <br />in the neighborhood and elsewhere in the City of Ramsey. That this will be assured by <br />the restrictive covenants to be filed with the PUD, as well as relevant City regulations. <br /> <br />The motion for the adoption of the foregoing Findings of Fact was duly seconded by Mayor <br />Gamec and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec, Councilmembers Sorte~)erg and Schlueter <br /> <br />and the following voted against the same: <br /> <br />N one <br /> <br />and the following were absent: <br /> <br /> Councilmembers Reimann and Van wagner <br /> <br />whereupon said Findings of Fact were declared duly passed and adopted by the Ramsey <br />City Council this the 1Zth day of March, 1984. <br /> <br />ATTEST: <br /> <br />Mayor <br /> <br />City Administrator/Clerk <br /> <br /> <br />
