Enclosure (D3-b)
contains an excerpt from the State Statute which provides for the Council to
have a closed meeting.

I
I
I

According to the State Statute, the City would have to accomplish the following:

1) Council would have to vote to have a closed meeting. This would take
a majority vote.

Z) Council would then adjourn the regular meeting and open the closed meeting.

3) We would then have to tape record the meeting and keep separate minutes
of it.

I
I
I

4)

We would need in writing Councilmembers and other persons in attendance
at this meeting.

5) We would have to preserve the tape recording of the meeting for two years.

In view of the Council Personnel Committee's request, the back-up material will
be made available to Councilmembers at the meeting.
